The problem with "Hate crimes".
They are at their root a thought crime.


If you sodomize a guy with a rotary air hammer - it is a crime - assault/sodomy.... If you do it because the guy is different than you - they then want to tag along an extra offense - you hate the guy.

What if you hate the guy - but don' t sodomize him. Why isn' t that thought still a crime?



Think that is silly?


Wait till the powers that be decide it is legit.


If you said " hate crime" in a US court 50 years ago you would have been laughed at.

The first hate crimes statutes were signed into law in 1968, and yeah..sure...you might have been laughed at in a court room then....but there's a good chance you'd be laughed out of a courtroom for all sorts of shit at the time. That's what made the civil rights act and hate crimes statutes necessary in the first place.

At any rate, a hate crime isn't a thought crime. You've done something, not just thought something. Let wonder lead you to knowledge.

Of COURSE it is a thought crime..

Nope. Safe bet your ass feels exactly the same. No further harm is caused by hate.

Your Supremes ruled that enhanced penalties for hate crimes are not punishing thought, therefore these are not thought crimes (much in the same way that SC rulings have help enshrine the right to own guns).

Furthermore, it has been determined that lesser courts may consider motivation when determining penalties. Thus, you taking a rotary hammer to your boyfriend’s bumhole may or may not be a crime, and if it IS a crime, your punishment may vary depending on why you engaged in this particular kink.

That just says what is legal - not right or wrong.

No, they aren't a thought crime.

They are an action crime.

If you kill someone because they slept with your wife, it's a crime.
If you kill someone because they're black, it's also a crime.

But the two crimes aren't the same. And targeting someone because of their race/sexuality/religious stance is inherently worse than just killing someone and thus deserving of a harsher sentence. It also says that you are predispositioned to commit the crime again, against the same race/sexuality/religious stance. Which makes you a threat to society.
"Tradition" is just a word people use to make themselves feel better about being an asshole.

Hate crimes are not thought crimes your free to think whatever you like. The moment you bring those thoughts in the real world you are liable for them because you can cause harm with them in the real world.

There is a difference between premeditated, reckless and accidental murder. Is it a thought crime? I would say no, it's an evaluation of the intent behind an action. It goes in increasing levels of punishment... 1. oops 2. I just didn't give a crap 3. yeah I planned it 4. I planned it because I'm a bigot

Seems a pretty simple concept to grasp.

By that metric anyone who has ever displayed bigotry or prejudice is guilty of a crime and deserving of jail time.
