If these people are criminals they should be tried in a court of law and given the chance to defend themselves... oh, sorry, that only happens in civilised countries.

As I mentioned in another thread, being in the US illegally is not, in and of itself, a crime. But that’s neither here nor there - anyone being deported should have the right to challenge it.

All Constitutional rights, including the right to due process, are extended to all people in America, including noncitizens, including illegal aliens.

Although most cases are in the early stages of adjudication, at least six in which defendants challenged the charges have been thrown out by judges or withdrawn by prosecutors amid questioning from the courts, according to a Washington Post analysis of court records. More than a dozen others have already pleaded guilty.

In some instances, judges chided prosecutors for relying on a statute that has not been widely enforced in more than half a century to target people who until just weeks ago had no way to comply.

^I stand by my original statement. Being in the US illegally is a civil offense, not a criminal one. Failing to register under this archaic, rarely used statute may be a criminal offense.

In the beforetimes they would use misdemeanor entry on the marriage fraud subsection, as many immigrants are married to citizens, and deporting one parent very often leads to the effective removal of undesirable families.

I realize that exceptions to the Constitution's delegation of tariffs to Congress have been written into law, but Trump is pressing the boundaries of any reasonable interpretations of those laws to make them do what he wants them to.  That's what the judges' pushback on his interpretation of the IEEPA was about.  And yes, Trump can resort to other laws to try to impose the same tariffs.  But he is certainly testing the limits of presidential powers, and is undermining essential checks and balances in the process.

If Congress was in the hands of Democrats, Trump would already be constrained by their pushback against his abuse of the tariff laws.

The current court has already ruled that TACO is immune from criminal prosecution for any acts he commits or orders in office, provided he deems them to be official acts.  This is in direct contradiction to the constitution.  An earlier "conservative" court declared a blanket right to gun ownership, also in direct contradiction to the constitution.  There is no act so repugnant, so illegal or so immoral that a conservative court will not deem to be illegal, as long as it is in the service of wealth.
