End of the day for the nutjobs, it's not really motivated by principle. They just overcommitted to a bit and ended up enemies of the people on account of it.

Presidents already have that ability, and, the presidency being an office, it accrues more and more power with time, while being loathe to ever relinquish an inch of what it's already gotten.

Seeing as the South was generally treated as a conquered nation, it's different. That was the Reconstruction Era. Southern states, and not even all, didn't even have members in the US congress until the 40th US Congress.

Excuses Excuses .....
It was a significant piece of legislation that was decided by EO. Hair splitting won't make it less so. So I guess the Confederates were right that Lincoln was a tyrant.....

The south was treated exceptionally well, it's a general misperception, that it was treated as a conquered nation. I think misperception may be at the root of more than just that one little item of trivia. As for lincoln being a tyrant, meh, more that the us decided then and there that it did not acknowledge a great many things held, beforehand, to be foundational to us. No matter how much a given person wanted it. Be that self determination or slavery.
