Well, I have been to a party at which a bunch of morons convinced a even bigger moron to stump a dishwashing tablet and to then snort that stuff - resulting in hospitalisation, almoust death and a courtcase which came to the conclusion that those involved werent criminals but certainly stupid.
I have been in a pub in which a drunk dumbfuck convinced himself and others to drink windowcleaner, 4 hospitalisations and one death, plus a courtcase which gave minor sentences.
I heard of a bunch of guys in a place nearby who found a world war 2 handgranade in a riverbed and then played "throw and catch" with it - I guess that you can guess which kind of fatal results such stupidity brings.
And there was this bloke who I knew who was convinced by a bunch of friends to climb on a high voltage power pole and was as a result fried and his friend convicted for treaspassing and involuntary manslaughter.
And I know someone who had his shot of absinthe set on fire, yet was dumb enought to think that he could still drink it.

Some people are stupid enought to do the dumbest and most dangerous things.
Some people are stupid enought to convince others to do the dumbest and most dangerous things.
And some people are dumb enought to convince others to do the dumbest and most dangerous things, but give the fatal blow themselves by not realising the stupidity of their own actions.

So I am guessing, and it is only a guess, that this is not a case of homophobia - but a case of servere stupidity - which doesnt make the thing less worse.

Stripping a person naked in public is a way of humiliating them. Bullies need to exert dominance, and humiliating another person is a way that they assert superiority, not only over the victim, but over everyone who sees it and does not step in to stop it.

I would not doubt if the fact that he was disabled gave the court the impression that the dead teen just did not know when to say "stop". Being gay may and easily could factor into it. But this could also have been a case of extreme drunken fucked up stupidity. Honestly, I can only speculate. It's horrid no matter what. And the sentencing makes no fucking sense.

In the US, crimes you commit while intoxicated often result in similar sentences to ones you commit while sober.

The choice to get inebriated comes with the expectation that you understand that you are responsible for your actions.

Europeans seem to think being compromised is an excuse, at least in their "justice" system.

No one forces you to drive. No one forces you to drink.

Nope! Absolutly not! Sentences are always higher if you commit a crime whilest intoxicated.

The sentences given in Europe are generaly lower and we have a justicesystem built to focus on resocialisation and not on punishment (at least in most EU countries)
