San Francisco Archbishop Accused of ‘Breathtaking Lack of Empathy’ in Bankruptcy Filing

Survivors of childhood sexual abuse at the hands of Catholic priests and teachers harshly criticized the Archdiocese of San Francisco’s decision to file for bankruptcy during a public call Thursday with the local archbishop.

Over roughly three hours of discussion, victims and their family members described how their experiences as children haunted their adult lives. At times, they said the archdiocese demonstrated a lack of transparency and commitment to reaching an equitable settlement with them.

victims said the very decision to file for Chapter 11 bankruptcy had denied them the opportunity to have their stories heard in court.

Madeline McFeely, a survivor and member of the committee, called bankruptcy a “soft landing” for the archdiocese.

“It seems to me that although you profess understanding, your actions, the actions of the bankruptcy do not demonstrate that,” she said. “In fact, it seems that there is a breathtaking lack of empathy.”

In August, the Archdiocese of San Francisco announced it was filing for bankruptcy under the weight of more than 500 lawsuits over childhood sexual abuse.

Diocese: Unable to reach settlement with Long Island clergy sex abuse survivors

The diocese said it had been offering the survivors an average of at least $400,000 each, but attorneys for the survivors said that was far too little. The attorneys said they expect the cases to now be sent back to state civil court, where awards could be even higher.

Attorneys for survivors said the offer was inadequate given the diocese’s assets, and that the $100 million spent on legal fees could have gone to their clients.

“For a child who was raped by their priest, $400,000 is grossly inadequate,” said Jordan Merson, a Manhattan-based attorney representing some of the survivors.

“The diocese throughout this process has continued to try to minimize and bully survivors," Merson said, "and this letter is just another example of it.”

The diocese declared bankruptcy in October 2020, saying payouts from the CVA could leave it in financial ruin. The diocese has previously paid out a total of about $62 million to 350 survivors under an “Independent Reconciliation and Compensation Program” that began in 2017.

They were brothers Big Nose and Pigskin, Hamburger Lips and Pinching Lady, sisters Grasshopper, Skunk and Pig — aliases and Cree epithets the children of St. Anne's residential school in Fort Albany, Ont., gave their alleged abusers.

They're among 180 alleged perpetrators listed by 152 survivors in 61 lawsuits, filed against the Canadian government and Catholic Church in the early 2000s. But in some cases, like those above, the now-adult children could only recall the nicknames.

"It's really haunting, because you realize that these were names that were whispered among children, and whispered as warnings," said Charlie Angus, New Democrat MP for Timmins-James Bay, whose riding encompasses Fort Albany where St. Anne's operated.

"This was supposed to be a school. Instead it was a torture chamber, a place for pedophiles."

Former Jesuit Rupnik, accused of abusing women, welcomed into Slovenia diocese

The Diocese of Koper confirmed in a statement sent to The Associated Press on Oct. 26 that the Fr. Marko Ivan Rupnik was accepted as a priest there in August.

Rupnik was taken in because he had been expelled from the Jesuits and because the diocese hadn't received any documents showing that Rupnik had "been found guilty of the alleged abuses before either an ecclesiastical tribunal or civil court," it said.

The scandal has been a headache for the Vatican and Pope Francis himself due to suspicions Rupnik received favorable treatment from the Holy See since Francis is a Jesuit and other Jesuits head the sex crimes office that investigated the priest and declined to prosecute him for abuse.

The Catholic Church has long responded to women who report priests for abusing their authority by blaming the women for seducing the churchmen, portraying them as mentally unstable or minimizing the event as a mere "mistake" or "boundary violation" by an otherwise holy priest.

More recently, Francis was seen as being part of an apparent attempt by Rupnik's supporters to rehabilitate the priest's image. In a widely publicized audience, Francis received a close collaborator and strong defender of Rupnik's who has denounced what she called a media "lynching" of him.

In a statement last month, the Vicariate of Rome, which Francis heads, cast doubt on the Vatican's lone punishment of Rupnik – a 2020 declaration of excommunication that was removed two weeks later. Women who alleged they were abused by Rupnik said the statement revictimized them.

Spanish probe estimates more than 200,000 children abused by Roman Catholic clergy

Over 200,000 minors are estimated to have been sexually abused in Spain by the Roman Catholic clergy since 1940, according to an independent commission published Friday.

The report did not give a specific figure but said a poll of over 8,000 people found that 0.6 percent of Spain's adult population of around 39 million people said they had suffered sexual abuse by members of the clergy when they were still children.

The percentage rises to 1.13 percent -- or over 400,000 people -- when including abuse by lay members, Spain's national ombudsman Angel Gabilondo told a news conference called to present the findings of the report.

The revelations in Spain are the latest to rock the Roman Catholic Church after a series of sexual abuse scandals around the world, often involving children, over the past 20 years.

Australian Catholic church has so many sexual abuse complaints, its insurance company faces insolvency

The Catholic church insurer wants to establish a scheme that would stave off its own insolvency by paying church bodies only a fraction of the money owed to abuse survivors at rates to be determined by the scandal-plagued consultancy PwC, documents show.

Catholic Church Insurance is facing significant financial turmoil due to the rising volume of abuse claims, estimating it has $381m in liabilities relating to professional standards payouts to various church entities, including dioceses and church-aligned charities.

In an attempt to protect itself financially, CCI is asking the federal court to approve a legally binding scheme that, if it comes close to insolvency, would trigger a reduction in abuse payouts to church bodies. The scheme would allow the insurer to pay out only a yet-to-be-determined percentage of what is owed to survivors.

Based on the conclusions of the document delivered to the Congress of Deputies, it has been calculated that there are « hundreds of thousands of people » who have suffered « violence and sexual assault », Sánchez said. A « reality that everyone knew for many years but that nobody spoke of in the terms that we do today », he assured.

The Catholic church has lost a landmark case over its controversial use of the deaths of paedophile priests to thwart survivors’ attempts at justice.

Earlier this year, a Guardian investigation found that the church was now routinely using permanent stays in cases where perpetrators have died, either to defeat active claims before the courts or to low-ball survivors in settlement negotiations.

The tactic is causing profound harm to an already vulnerable group.

Critics say it is also immoral, given the church’s own role in delaying justice for decades, which included hiding abuse complaints from law enforcement and destroying or deliberately not keeping records.

Survivor groups argue the approach is at odds with the intent of Australian parliaments, which all removed time limits on bringing civil claims in recognition of the significant barriers to survivors coming forward.

The most recent filing from the Archdiocese of Baltimore’s bankruptcy proceedings shows the organization has more than $200 million in assets, which include a Tiffany tea set, a diamond-encrusted crucifix, a sapphire-studded locket and dozens of solid gold rings.

The filing is the first look into the Church’s holdings after more than a thousand alleged victims of child sexual abuse from the past 80 years are expected to seek retribution from their trauma.

Among the possessions:

•A gold ring set with an amethyst in the center surrounded by 28 diamonds.

•A locket with a profile of St. Peter surrounded by 16 sapphires and eight pearls.

The full list of collectibles spans 11 pages and is one of many insights into the finances and operations of the archdiocese.

The court filings also make it clear the archdiocese had considered bankruptcy for some time. Church officials paid various attorneys and consulting firms more than $750,000 over a one-year period for advice about how to handle a restructuring through the bankruptcy process, according to court records.

Although revenue is down, the archdiocese has significant land holdings and investments it can draw on, in addition to its collection of jewels and antiquities, to help pay the hundreds if not thousands of sexual abuse victims who are expected to bring claims. In its filing declaring bankruptcy, the archdiocese included a list of nearly 700 unnamed survivors for whom the church states it has addresses on file and who could bring claims against it during this process.

The archdiocese lists its total assets at more than $200 million, although that is likely an undercount. Properties are valued at what the archdiocese paid for them at the time of purchase and the collectibles — all the antiques and jewels — are not valued.
