And since then Homeland security has complied with the ban, and the Administration has sought legal means in court to overturn the court ruling.
I get the point you are making. But I don't think this specific scenario does a very good job highlighting it.
The real test will be what if he loses in court or can't find a legal means to fight the overturn. Just how far is he willing to go to "Win".
