Sadly he is right. There is no federal statute on sexual orientation. The SC has upheld or struck down state laws in certain cases and in the gay marriage case struck down the section of the Defense of Marriage Act for violations of the 14th Amendment. The conservatards on the court dissented vigorously... as one would expect from those tards.
