I heard the same figure used recently during a round table discussion on NPR concerning the political right and free speech on campuses. Assuming the polling is solid, it's a disturbing development.
40%?!? Hell, 1% is too damn high.
Nothing wrong with criminalising hate speech. Most of Europe does it and it has no impact on the quality or range of political discourse over here (except possibly improving it).
