One might argue that the amendment contradicts the intentions and spirit of the founding fathers (and I'd agree with you), but it's constitutional by definition, there's no argument there.
I like to imagine a USA where the Federal government remained restricted and acted more as a unifying body for states than anything else, like the EU or something. It would definitely be a different world, and there would probably be a Confederate States of America instead of a Civil War.
