This whole we aren't discriminating against homosexuals because we are outlawing everyone from ssm not just homosexuals has already been tried in Lovings V. Virginia except they said they weren't violating equal protections bc they were banning all people from marrying interracially not just black people. It was shot down by the US Supreme Court then and it should be shot down again now.
Baking and photography are basic rights under the ninth amendment....remember...pursuit of happiness...it means anything your want it to mean.
A judge could easily rule that a bakers pursuit of happiness is sufficient cause for him to refuse to serve gay weddings.
How did I miss this!? Lol! Heywood, love, please take a refresher course on the US constitution.
I haven't set foot in a classroom in 8 years. (Wow that is super depressing but don't worry I plan to start college, finally, this summer)
I'm pretty sure the fundamental rights as described in the constitution are;
Property- the right to own property pretty self explanatory.
Travel- the right to travel freely. I cannot remember if this is just from state to state or if this includes traveling abroad.
And
Privacy-privacy is trickier so over the years things were added to it so that everyone would know hey this counts under privacy
Contraceptives- the right to buy/use contraceptives came from a case that started in Georgia I think
Abortion-this one is too famous I am sure you know.
Marriage-I am pretty sure this was established before Lovings V. Virginia. If you haven't read the case it's easy enough to find. The Opinion (can't remember who is was written by) was worded very nicely. You could easily replace the word race with sexuality and have a perfect argument for why same sex marriage should be protected under privacy and the equal protection clause.
P-I can't remember what the P stands for
Education- the right to homeschool your children I'm pretty sure
Relation- this is right to live with your extended family.
Sexual Orientation- basically the right to have private sex with legal consenting adults of the same gender as you
I think the right to refuse medical treatment is in here too but I can't remember how to fit it with campers.
Baking, photography, and happiness didn't make the cut...
