Padraic, Paterno was told that one of his assistant coaches was seen in the act of sexually molesting a child. Paterno told his superiors, but did not follow up. He did not do enough, but there are others that held more responsibility to act than he did (legally). My point of view is not a fallacy of any kind. He should have done more, but he is not as responsible for allowing it to continue as his superiors are.
The good news is that Sandusky was found guilty of 45 counts of child sexual abuse. The bad news is that people like Paterno could have stopped that monster much sooner.

He could've gone public with it too after investigating it himself, which he most likely did.
If he didn't, it calls his character into question.
If he did but then remained silent for a while, then he is guilty of aiding and abetting it.

The notion that a great sportsman must also be an outstanding appeaser of the contemporary public sensibility is, in my opinion, a lot of self-import and self-serving baloney served up by the sporting establishment for its own aggrandizement.
A field ought to recognize those who advanced its own art even if the contributor is not the greatest of all round human beings.
I think Watson deserves his Nobel prize for his discovery of the role and structure of DNA not a bit less even if he did steal fruits of someone else's work without giving any credit, and a racist bastard to the end. Paterno is no where near as faulty a person as far as I can tell. So build him his statue as long as people indulge in the frivolous reverence of sports heroes.

Joepa should have done more and I believe he knew this, but how much did he really know is the question. Joepa has done a world of good for the young men that came through the Penn State program, he turned down pro contracts that would have made his at Penn State look pitiful. His reason for doing so, he felt he could help those kids become successful young men who could contribute to their own communities. I believe the decision of whether or not to put up a statue should be left up to a community that knew him best. I'm not a Penn State fan (my blood runs orange), whoever I have a great deal of respect for a man who cared for those under his charge, than he did for his own personal gain, Joepa saw gain as boys becoming men not wins and losses.
God loves those who believe and those who do not and the same goes for me, you have no choice in this matter. That puts the matter of total free will to rest.
