Ok, before the next round of bitching and personal abuse starts - don't.
At the age of five, Skagra decided emphatically that God did not exist. This revelation tends to make most people in the universe who have it react in one of two ways - with relief or with despair. Only Skagra responded to it by thinking, 'Wait a second. That means there's a situation vacant.'

And yet he still hasn't replied to me. Claims everyone's an idiot but can't respond to my deconstruction of his stance. Disingenuous.

Well in the past, cheating would not only be a huge injustice to one's spouse, but it would be a huge injustice to the children and a child that might come out of that relationship. I understand now that cheating can be done with "safe" sex but it's still an injustice to the children who are already born.
Some people believe implementation of laws should be to seek justice (eye for an eye type of thing). Others think it should be to stop a problem but not with the intention of implementing justice.
If the latter is the spirit we should have, it might be to not allow a culture where almost half the people cheat on their spouses to arise. To make it look so looked down upon by society, that very few will commit it.
In this regards, a greater good comes out to society. As the Vulcan saying goes "The needs of the many outweigh the needs of an individual".
