Seems like a simple case of negligence which is addressable as a civil matter. Someone at the sperm bank had the wrong glasses on.
Even racists have rights to sue in America. thanks for the reply, I can kind of guess your answer but..
What are the damages?

Besides....I thought you were a big fucking fan of fetuses?
Another person who did not actually follow the argument I was presenting.

I've heard it so many times and the truth is I don't give a flying fuck about fetuses.
It is no skin off my nose if a woman I don't know does or does not want to have a kid. What I don't understand is, why do you care?

And, as far as what the "damages" should be, that is up to the court or at least an amount was not specified in the article. I do know that this:
Quote:A month after Cramblett said she learned of the mistake, according to the lawsuit, the sperm bank sent her a typed letter of apology along with a refund check for the six vials of incorrect sperm that were sent to her in September 2011.
isn't going to cut it. However it is an admission of the error and I'm sure her lawyers will lose no time making the point.

Wrongful sperm delivery? That could be a sticky issue.

I suggest you actually read what I said instead of what you think I said.
Your comments have nothing to do with the argument I presented.

"Well, evolution is a theory. It is also a fact. And facts and theories are different things, not rungs in a hierarchy of increasing certainty. Facts are the world's data. Theories are structures of ideas that explain and interpret facts. Facts don't go away when scientists debate rival theories to explain them. Einstein's theory of gravitation replaced Newton's in this century, but apples didn't suspend themselves in midair, pending the outcome. And humans evolved from ape- like ancestors whether they did so by Darwin's proposed mechanism or by some other yet to be discovered."

Seems to me at this point the lawsuit says the community is bringing the hardship as a way to not implicate the child as having something wrong with it.
I don't see how the donor bank is going to be held responsible for a community's racism.
