The biology of your sex is more about how your brain works than which sex organs you have. There are large biological differences in the brains of straight women, straight men, and gay folks of either sex.
Transgender do not have to brain biology of a straight person of their physical sex.

There are already individual stalls in both sexes restrooms, so that would be a waste of money and restrooms. Maybe, if a mens restroom was a circle of low urinals all facing inwards towards each other...and women's restrooms were rows of free standing toilets made out of transparent materials on a mirrored floor...there would be cause for concern....but....

I'm surprised that I read atheists supporting the notion that our sex is determined by which one we think are, rather than what we are biologically.  I always get lectured about scientific evidence and so on.  Our sex is not determined by what we think we are, but rather by what we are biologically.  If you anatomically male or female, then that's what you are.  I'm white and it doesn't matter how much I may think I'm black, I'm still white.  If a person has a sex change operation, then there is no problem with restroom or locker room use.  Teenage high or junior high school girls should not have to share a restroom, or especially a locker room with a person with male equipment.  That's why they have boys and girls facilities.  Transgenders should be respected and accommodated in the best way possible, such as  separate private areas.  Male transgenders in high school locker rooms would be in danger of harassment.  I think the locker room thing demanded by the Obama administration could finally be the thing that causes sane people to revolt against the insanity.  It's about time to stop infringing on the rights of 99% of the people to accommodate those of 1%, when it can be done in a better way.  I hope other states follow the lead of North Carolina and rise up against this stupidity.

A question for our resident theists. Since you seem to be so adamant about transgenders using the "proper" pooper, how do you feel about straight up opposite sex handicapped assistants? I mean some guy with a penis might have to enter the ladies room to help his handicapped wife drop her deuce! Holy fuck, the horror.

If you really have a problem with men parts in the ladies room or lady parts in the mens, then I guess you'll be starting the petition to put a halt to this?

OK so let's stick with scientific evidence.

• There are differences between male and female brains.
  
• It is not an either / or situation. Some people have more female characteristics, some more male.  
  
• Brain scans of transsexuals show that they do have the brains of the gender that they identify with
  
• There are no differences between brains of different races, say black and white.
  
• Gender identity is not the same as biological sex. When children have been raised from birth being told that they are a different biological sex, say because they had an operation on malformed genitalia, they have retained their birth gender instead.
  
• Is it is not a lifestyle choice. The only cure for transsexuality is to allow the patient to transition. Nothing else works.
  
• No one would choose to be transgendered.

• There is no problem in any other country that allows transgendered people to use the bathrooms for the gender that they identify as

• There is no problem now. This is a solution looking for a problem that does not exist.
  
• A 'sex change' is not an instantaneous thing. Transsexuals need to live at least a year before they are allowed sex reassignment surgery. Where are they supposed to use the toilets during that time? It is often many years before they can obtain the surgery due to cost.
  
• These laws create many problems that never existed before and solve none.
  
• Trans people are already at real risk due to violence, sexual and physical abuse and suicide. These bathroom laws increase those risks massively.
  
• Your fake caring about the welfare of transgendered people is fooling no one.
