With little explanation, diocese has reinstated 17 priests accused of sexual abuse

Seventeen of the 29 Buffalo Diocese priests put on administrative leave since 2018 due to a sex abuse allegation involving a minor were later allowed to resume their priestly activities.

The diocese publicized the priests’ returns to ministry by stating that a review board had examined the claims and found them to be “not substantiated.”

Diocese officials maintain that the review process is rigorous, independent and designed to protect children from potential abuse.

Accusers and their attorneys aren’t convinced, and they worry that some priests are being publicly exonerated and put back into contact with children without a thorough and impartial investigation into abuse claims.

They point out that in some cases a priest was returned to ministry, even though his accuser wasn't interviewed as part of an investigation.

The most recent reinstatement of a priest was in July, when Bishop Michael W. Fisher restored the faculties of the Rev. Raymond A. Donohue, who was accused in a Child Victims Act lawsuit and a confidential bankruptcy claim. Donohue denied the allegation.

The diocese said the plaintiff's attorney refused to allow an investigator to interview his client.

Steve Boyd, the plaintiff's attorney, described the board as a “public relations wing of the diocese” that was created to “try and find ways to put priests back into ministry.”

“Right now, it is a secret committee that does secret work, and we find out their findings later, without knowing anything about what their process is.”

If law enforcement won’t investigate because criminal statutes of limitation have expired, dioceses might consider turning to an external review by independent experts who have no connection to the church, Hamilton said.

Cdn Inuit delegation heading to France to pressure French gov’t to extradite ex-priest

Next week, Steve Mapsalak will travel with a delegation of Inuit led by Nunavut Tunngavik Inc. (NTI) to try to get the French public to put pressure on their government to extradite a former French Oblate priest, Johannes Rivoire, who once lived and worked in northern Canada.

Mapsalak was taken from his parents when he was six years old and forced to attend the Sir Joseph Bernier Federal Day School in Chesterfield Inlet. He’d go home to Naujaat for three months of the year until he was age 13.

That’s where he alleges Rivoire sexually abused him.

In the 1990s, Mapsalak said he was approached numerous times and asked whether he wanted to press charges against Rivoire, but the flashbacks were too difficult.

He eventually agreed, and the first warrant for Rivoire’s arrest was issued in 1998, but Rivoire had fled to France in 1993.

Since there is no extradition treaty between Canada and France, Rivoire doesn’t legally have to return to Canada to face those charges.

Pope Francis is lying about having ‘zero tolerance’ for sexual abuse

In a lengthy interview with CNN Portugal, Pope Francis insisted, falsely, that he had a “zero tolerance” policy when it came to the sexual abuse of children.

In an exclusive, wide-ranging interview in Rome last month, the Pontiff said the church had “zero tolerance” for abuse and said that “a priest cannot remain a priest if he is an abuser.”

The church’s response to sex abuse scandals has become one of the defining themes of Francis’ time as Pope, and he told CNN Portugal that every case of abuse within the church “hurts” him.

His statements stand in stark contrast to his actions when faced with evidence of sexual abuse. CNN lists just a few of the times Pope Francis has downplayed allegations of child sexual abuse or taken the side of priests

Multiple reports detailing decades of sexual abuse, systemic failures and cover-ups across multiple countries have been released since Francis became the leader of the world’s 1.2 billion Catholics in 2013. While he was criticized for some of his actions — such as when he defended a Chilean bishop accused of covering up a sex scandal in 2018, a decision he later described as a “grave error” — he has since taken a firm stance on the issues and introduced some reforms.

It’s not like the pope just made one error, though. In 2019, Cardinal George Pell was sentenced to six years in prison for child sex abuse, or, as his lawyer callously called it, nothing more than a “plain vanilla sexual penetration case where the child is not actively participating.” In 2020, the conviction was controversially overturned when the High Court of Australia said the jury lacked enough doubt about the testimony against Pell.

What was Pope Francis’ reaction? He spoke out against “unjust sentences” and compared Pell’s situation to how Jesus was persecuted despite being innocent. The pope didn’t acknowledge almost certain guilt that was overturned on a technicality; he acted like Pell had done absolutely nothing wrong.

Court upholds ex-priest's 30-year sentence for abusing children

Spain’s Supreme Court has upheld a 30-year prison sentence for a former priest who sexually abused seven boys at a boarding school.

The court found that the abuse took place at a seminary school in the city of Ciudad Real between 2013 and 2016.

The victims were all aged around 13 at the time. During swimming lessons, the defendant pulled some boys into the water by grabbing their genitals, the court said, and forcing others to stand naked in front of him as a “test of trust”.

“We don’t often see these long sentences. Previously, the Supreme Court had even reduced some sentences. Priests rarely go to jail in Spain. I hope [the decision] opens a path for this to become usual,” ANIR founder Ana Cuevas told the Associated Press.

A Spanish committee is currently investigating more than 200 complaints of sexual abuse against members of Catholic church institutions.

'No kid should be residing in the rectory': Child protection part of clergy abuse settlement

Clergy sex abuse survivor Leo Tudela told the bankruptcy court the settlement deal with the Archdiocese of Agaña will have more protection for children, following a dark chapter in the local Catholic Church’s history of child sexual abuse from the 1950s to the 1990s.

Archdiocese attorney Ford Elsaesser said the settlement is in the range of “at least $34 million to $45 million,” depending on the actual sum that the sale of archdiocese properties would bring in.

The court-filed joint disclosure statement also indicated that between the various forms of funding for the plan, tort claimants will receive the total sum of between $37 million and $101 million.

“No kid should be residing in the rectory,” Tudela, 79, said in court as he cited examples of specific, easy-to-understand items in the Child Protection Protocols that abuse survivors and the archdiocese have been drafting as part of the settlement.

Several of Guam’s 270-plus clergy sex abuse claims alleged priests abused minors in the priest’s residence or the rectory. Many of the children were residing in the rectory as well.

Tudela said the protocols also include not allowing any child to ride in a vehicle alone with a priest or another clergy member.

Churches defend sex abuse reporting loophole

In 33 states, clergy are exempt from any laws requiring professionals such as teachers, physicians and psychotherapists to report information about alleged child sexual abuse to police or child welfare officials if the church deems the information privileged.

This loophole has resulted in an unknown number of predators being allowed to continue abusing children for years despite having confessed the behavior to religious officials. In many of these cases, the privilege has been invoked to shield religious groups from civil and criminal liability after the abuse became known to civil authorities.

The AP found that the Roman Catholic Church has used its well-funded lobbying infrastructure and deep influence among lawmakers in some states to protect the privilege, and that influential members of the Mormon church and Jehovah’s Witnesses have also worked in statehouses and courts to preserve it in areas where their membership is high.

In Maryland a successful campaign to defeat a proposal that would have closed the clergy-penitent loophole was led by a Catholic cardinal who would later be defrocked for sexually abusing children and adult seminarians.

In other states, such as California, Missouri and New Mexico, vociferous public and backroom opposition to bills aimed at closing the loophole from the Catholic and Mormon churches successfully derailed legislative reform efforts.

Last month, an AP investigation found that a Mormon bishop in Arizona, at the direction of church leaders, failed to report a church member who had confessed that he sexually abused his 5-year-old daughter. The AP found that Rep. Merrill Nelson, a church lawyer and Utah Republican lawmaker, had advised the bishop not to report the abuse to civil authorities because of Arizona’s clergy privilege law, according to documents revealed in a lawsuit. That failure to report allowed the church member, the late Paul Adams, to repeatedly rape his two daughters and allegedly abuse one of his four sons for many years.

In response to the case, state Sen. Victoria Steele, a Democrat from Tucson, on three occasions proposed legislation to close the clergy reporting loophole in Arizona. Steele told the AP that key Mormon lawmakers including a former Republican state senator and judiciary committee chairmen thwarted her efforts before her proposals could be presented to the full Legislature.

“It’s difficult for me to tell this story without talking about the Mormons and their power in the Legislature,” Steele said. “What this boils down to is that the church is being given permission to protect the predators and the children be damned. … They are trying with all of their might to make sure this bill does not see the light of day.”

Latter-day Saints and Catholics hold a number of influential positions as leaders and committee chairmen in the Arizona Legislature, including the speaker of the House, and have been known to advance or block legislation in line with the church’s priorities and values.

Lawyer fined $400,000 for warning school about predator priest on staff

Earlier this year, attorney Richard Trahant discovered that a chaplain at (private Catholic) Brother Martin High School in New Orleans, Louisiana had previously been accused of sexual misconduct. Trahant contacted the school and informed them of what he had just learned. Within days, that chaplain, Paul Hart, announced his “retirement.” That lawyer has now been fined $400,000 for warning people about the predator priest.

Son of JRR Tolkien was a Catholic priest who molested kids

The archdiocese was apparently aware of the alleged abuse by Father Tolkien but did not report it until decades later, the inquiry heard.

The priest later died facing no charges.

Between 1970 and 2015, there were 3,000 complaints and 133 convictions. Millions were paid in compensation to victims.

The Catholic Council offered an "unreserved apology" to all victims and said it was reaffirming its commitment to the "continued refinement and improvement of our safeguarding work to protect all children and the vulnerable".

Daniel also said he was campaigning to have a Stoke-on-Trent road, named after the priest, to be "taken down".

Tolkien Way, close to the church where the victim suffered abuse, "is not named after the author", he explained.

Denouncing clergy sex abuse, Santa Fe Archdiocese files $121 million settlement plan

“For many years, clergy members within the Church violated the sacred trust placed in them by families, children, and the Church by committing acts of sexual abuse,” the Archdiocese of Santa Fe said in one bankruptcy filing on Oct. 11. “This was left unaddressed for decades. Survivors of abuse were ignored, called liars, shamed and felt abandoned by their Church. This conduct is contrary to the teaching and traditions of the Church.”

There are nearly 400 clergy sexual abuse victims involved in the settlement. Some incidents of abuse date back more than 60 years. When the archdiocese first filed for bankruptcy in November 2018, it faced only 35 to 40 active claims.

Lawyers for abuse survivors have said previous Catholic Church leaders in New Mexico covered up sexual abuse and transferred abusive priests to different parishes.

The Santa Fe Archdiocese’s website lists credibly accused clergy who worked in the archdiocese. There are 29 clergy listed as living, out of 80 on the list. There are another nine priests credibly accused of abuse in other dioceses but who spent time working in the Santa Fe Archdiocese.
