'Another level of coverup': How a Mass. law prevents clergy abuse survivors from getting justice
It can take decades for an adult who survived sexual abuse as a child to bring a lawsuit. That’s the case for many who were abused by trusted members of the community, like Catholic priests. But in Massachusetts, even if a survivor of clergy abuse decides to sue, state laws can stand in the way of justice.
The first hurdle is the statute of limitations. If a victim is older than 53 and it’s been more than 7 years since they realized the abuse harmed them, the statute of limitations applies — meaning it's likely too late to bring a lawsuit.
The second obstacle is known as the charitable immunity law, which applies to nonprofit charities. It generally limits the liability of charitable organizations, including Catholic dioceses, to $20,000. (Medical malpractice lawsuits against a nonprofit provider are capped at $100,000.)
Eric MacLeish has been one of the lead attorneys on clergy abuse cases against the Archdiocese of Boston and has sued all the dioceses in the state.
"Massachusetts has the worst charitable immunity statute in the country," she said.
Robb said her group is working with state lawmakers to eliminate the $20,000 cap for child sexual abuse claims.
"It’s time for Massachusetts to come out of the dark ages," she said.
Massachusetts used to give nonprofits complete immunity from all liability, based on the idea that charities get their money from public donations and those funds should be used only for charitable work. In 1971, lawmakers took away this blanket immunity, but capped damages.
"That purpose has long passed," he said, "because most charities — I shouldn't say all — but a charity like the Catholic Church is a very wealthy, powerful organization. They're not little Podunk entities that would wither if they had a significant lawsuit."

‘An offense against God’ - Sisters say Vatican abuse response not enough
The women say that Fr. David Nicgorski, formerly the superior general of the Oblates of the Virgin Mary, groomed them in spiritual direction while they were members of the Daughters of St. Paul, leading in one case to an alleged sexual assault.
But while the Vatican has prohibited Nicgorski from serving as a spiritual director for five years, the sisters say the decision was not enough, and the priest could eventually abuse other women.
“He asked me my name. And I told him my religious name, Aletheia. But he seemed to have already asked someone about my name, because he was unsurprised, like, waiting for me to finish so he could tell me something.”

Father Gabriele Martinelli sentenced to two and a half years for abusing altar boy at youth seminary few yards from Pope Francis’s residence
A Catholic priest has been jailed for sexually abusing an altar boy within the walls of the Vatican in the first legal case of its kind.
In what the Italian media called the “Pope’s choirboys” case, Father Gabriele Martinelli, 31, was sentenced to two and a half years in prison by a Vatican court for sexually abusing a minor when both of them were enrolled in a youth seminary located just a few yards from Pope Francis’s residence.
It was the first Vatican trial involving sexual abuse inside the walls of the Vatican, the world’s smallest sovereign nation.
The St Pius X youth seminary was a residence for boys aged 12 to 18 who served as altar boys at masses led by the Pope in St Peter’s Basilica.
At an initial trial in 2021, Martinelli was acquitted of accusations he had forced his victim, known only by the initials LG, to “undergo carnal acts, acts of sodomy, masturbation on himself and on the boy, at different times and in different places inside Vatican City”.
But his acquittal was overturned on Tuesday by a Vatican appeals court. Martinelli was found guilty of corrupting a minor by forcing him to have sex and fined €1,000 in addition to his jail term.
In the initial court ruling, Father Enrico Radice, 74, the former rector of the seminary, was cleared of covering up the abuse because of the expiration of the statute of limitations.
Victim accused of vendetta
Both Martinelli and Radice have consistently denied wrongdoing and accused the victim of having a personal vendetta against them.
The case came to light when the abuse was reported by another altar boy who shared a room with LG.

Retired priest, 80, who paid men for sex found murdered in bed
An 80-year-old priest suspected of paying migrants for sex was found dead and naked in his bed at his Catholic Church-owned apartment in Spain.
Police in Valencia have arrested a 40-year-old man over the violent death in what they believe was a dispute between lovers.
The suspect is described as being of South American origin. He is alleged to have killed the priest and then taken his mobile phone and wallet.
Alfonso López Benito, the retired canon of Valencia Cathedral, was found in bed on Tuesday.

Southern Baptist sexual abuse cases show strong similarities to Catholic cover-ups and incompetent leadership
Federal lawsuit accuses Southern Baptist Convention of covering up sex abuse
MEMPHIS, Tenn. — A federal lawsuit filed in Nashville, Tennessee, accuses the Executive Committee of the Southern Baptist Convention (SBC) of covering up and concealing sex abuse, and it mentions Memphis’ Bellevue Baptist Church and its senior pastor Dr. Steve Gaines.
Bellevue and Gaines are not specifically named as defendants in the lawsuit, which claims the Southern Baptist Convention leaders denied the rights of sexual abuse survivors by covering up abuse by church members and employees.
The lawsuit accuses the SBC leaders of being aware of abusers who seek employment as pastors and staff, allowing them to obtain positions of authority within the church leadership and holding influence over adults and children in the congregations. It claims convention leadership “has done little or nothing to train employees and agents to look for abusers, screen abusers or protect church members and volunteers from the sexual predators who infiltrate its ranks.”
The lawsuit cites a 2019 investigation by the Houston Chronicle and San Antonio Express-News which found more than 200 criminal cases and 700 victims over two decades involving Southern Baptist churches.
