New York Catholic bishops could tap into billions for ‘global’ sex abuse settlement

As the future of six Catholic dioceses in New York remain clouded by bankruptcies brought on by thousands of lawsuits from people who say they were sexually abused as children by clergy, a statewide settlement that would tap into a multi-billion-dollar revenue source appears to be under consideration.

Such a “global” settlement — which would likely need to be approved by Cardinal Timothy M. Dolan, the archbishop of New York, and possibly the state attorney general — could help resolve the bankruptcy proceedings that have frustrated aging survivors in Buffalo for more than four years because of their slow pace.

That prospect was welcomed by abuse survivors who spoke with 2 On Your Side on Friday, but the Diocese of Buffalo expressed skepticism about the idea, with a spokesperson for Bishop Michael Fisher saying the diocese was "not seeking to use" the funding source "to satisfy survivor claims."

Darren’s abuse by the priest ended when he was 11. His story remains one of the worst I’ve heard

So extreme had been Darren’s abuse by Tony Walsh that the former priest was sentenced in December 2010 to a total of 123 years imprisonment. Five of the 13 counts, for buggery, attracted sentences of 10, 12, 14, 16 and [another] 16 years each. The remaining counts, for indecent assault, brought sentences ranging from four to nine years each.

Walsh raped him with his wrists tied to his ankles as he was made to lie across a coffee table at the presbytery in Ballyfermot, which Walsh then shared with Fr Michael Cleary and his housekeeper, Phyllis Hamilton, with whom, it emerged later, Cleary had two sons. Darren was “crying loudly” and “hysterical”. Walsh, who had turned up the music to drown out the child’s cries, took “about an hour to calm me down. I then went home,” Darren said. This assault led to one of the 16-year sentences.

Another incident took place at Enniscrone, Co Sligo. About 50 children from Ballyfermot were taken there for a break by Walsh and three other priests, including Cleary. Walsh took Darren to the sand dunes where he raped him. The child was bleeding so Walsh brought him to the sea where he washed off the blood, but the salt water stung the child’s wounds, adding to his pain and distress.

Darren was also raped by Walsh in Dublin’s Phoenix Park. Afterwards, Walsh wiped him with “a purple sash [stole] he had with him”. He brought Darren back to the presbytery in Ballyfermot, “put on Elvis records . . . and gave me a glass of Coke”. “He then showed me a Bible with pictures of hell and said if I told anyone I would burn in hell and never go to heaven. Then he let me go home.”

One evening Darren told his mother a watered-down version of what was happening. They had been watching a BBC programme about child sexual abuse. Outraged, she went to the presbytery in Ballyfermot and knocked, accompanied by Darren’s aunt. The door was answered by Phyllis Hamilton, who denied that Walsh was inside.

Darren’s mother insisted he must be in because his car was there. They thought they had seen him through a window. Hamilton went inside and Walsh came to the door. He denied everything. As Prof Browne put it in the victim impact report: “then, knowing the game was up, Walsh stopped abusing Darren altogether and terminated their relationship”.

Tony Walsh spent eight years trying to stop his trial from going ahead, exhausting the judicial review process en route. He had failed similarly in another case in 1997. That time, after another round-the-houses judicial review process funded by free legal aid, he eventually pleaded guilty and served time. But he forced the December 2010 trial involving Darren McGavin by denying all charges. The jury found him guilty, unanimously, on all 13 counts after just 94 minutes.

Brazilian priest abused young girls, forced one to have abortion

A priest was arrested on Aug. 18 in the city of Coari, in Brazil’s Amazonas state, after a police inquiry concluded that he abused at least four teenagers.

One of them ended up pregnant and was forced by him to have an abortion.

Thirty-one-year-old Father Paulo Araújo da Silva was initially reported by an anonymous person in 2023. The police launched an investigation and talked to one of his victims. The 17-year-old teenager told the authorities that she and da Silva began a relationship when she was only 14. She said that he used to make and store videos of their sexual acts.

“She was undergoing strong psychological violence, because the priest not only co-opted the victims in his parish, but also forced them to remain in a relationship with him,” he said, according to local news website Amazonas Atual. Da Silva would never allow the victims to stop seeing him and even said things like “if you’re not with me, you won’t be with anybody else.”

All identified victims were churchgoers and members of the Diocese of Coari’s Saint Peter parish, headed by da Silva. According to the police, witnesses told them that the priest would always ask the victims to bring other girls, so they could have group sex. And he always made sure to tape everything.

When the agents broke into the parish to detain da Silva, he was on his bed with a young lady who had just turned 18, “which means that the priest already had sex with her when she was a minor,” Barradas said.

The police took control of da Silva’s smartphone and found at least 260 videos made by the priest showing sex acts with minors. The priest also had R$ 30,000 (about US$ 5,500) with him in his bedroom.

The priest will be indicted for crimes like raping minors or vulnerable people, ommiting assistance to children and teenagers, producing and storing pornographic contents involving minors, forcing an abortion, and menacing a woman of violence.

Ireland to set up inquiry into sexual abuse at schools run by religious orders

The Irish government is to set up a statutory commission of inquiry into sexual abuse at schools run by Catholic religious orders after a preliminary investigation found almost 2,400 allegations of historic abuse.

The investigation, led by a leading barrister, Mary O’Toole, documented 844 alleged abusers in 308 schools run by 42 religious orders across the Republic of Ireland.

One hundred and thirty seven people who participated in her inquiry completed in-person interviews and 12 provided written submissions.

Most of those who took part were men in their 50s and 60s.

The Irish education minister, Norma Foley, described the report as a “harrowing document, containing some of the most appalling accounts of sexual abuse”.

Allegations were made against the Spiritans, the Jesuits, the Carmelite Fathers, the Christian Brothers, the Sisters of Mercy and the Missionaries of the Sacred Heart.

It is understood that religious orders’ records indicate that more than half the 844 men accused of abuse are known to be deceased.

Those interviewed for the scoping inquiry described being molested, stripped naked, and drugged amid an atmosphere of terror and silence.

Some spoke of their strong belief that the abuse was so pervasive that it could not have gone unnoticed by other teachers or senior members of the religious orders.

Catholic Church sexual abuse victims call on Maryland AG to complete probe into all Maryland churches

Survivors of sexual abuse within the Catholic church are calling on the Maryland Attorney General to complete his investigation into abuses in all Maryland churches.

They also want the church to drop its challenge to a Maryland law that eliminates the statute of limitations for victims.

The Archdiocese of Washington, which controls several churches in Maryland, is fighting to keep the statute of limitations with arguments before the Maryland Supreme Court scheduled for next week.

"To me, it's my life goal to protect children from the abuse that I suffered, and we can do that going forward. The church says on one hand they want to support us and with the other hand, they want to take the law away" said Teresa Lancaster, a victim of abuse by Father Joseph Maskell whose story has been highlighted previously on WJZ and nationally in The Keepers, a Netflix documentary.

"It proved that everything we said happened in The Keepers did happen after the church said it was a bunch of lies," Lancaster told WJZ Investigator Mike Hellgren Wednesday.

Baltimore's archdiocese has filed for bankruptcy, a process that is still playing out in federal court that will determine any financial settlements paid out to victims.

"They are going to be reminded that the eyes of justice and accountability will remain firmly fixed on their culpability and their hypocrisy," said Frank Schindler of SNAP.

In the Pacific, a ‘Dumping Ground’ for Priests Accused or Convicted of Abuse

Pope Francis will be welcomed by children bearing flowers, a 21-gun salute and a candlelight vigil after he lands in Papua New Guinea on Friday. It will be the first papal visit in three decades to the Pacific Islands, a deeply Christian region — but one that has played a little-known role in the clergy abuse scandal that has stained the Roman Catholic Church.

Over several decades, at least 10 priests and missionaries moved to Papua New Guinea after they had allegedly sexually abused children, or had been found to do so, in the West, according to court records, government inquiries, survivor testimonies, news media reports and comments by church officials.

These men were part of a larger pattern: At least 24 other priests and missionaries left New Zealand, Australia, Britain and the United States for Pacific Island countries like Fiji, Kiribati and Samoa under similar circumstances. In at least 13 cases, their superiors knew that these men had been accused or convicted of abuse before they transferred to the Pacific, according to church records and survivor accounts, shielding them from scrutiny.

It has been widely documented that the church has protected scores of priests from the authorities by shuffling them to other places, sometimes in other countries. But what sets these cases apart is the remoteness of the islands the men ended up in, making it harder for the authorities to pursue them. The relocations also gave the men access to vulnerable communities where priests were considered beyond reproach.

Notably, at least three of these men, according to government inquiries and news media reports, went on to abuse new victims in the Pacific.

The pope’s next stop is East Timor. In 2022, the Vatican punished Bishop Carlos Ximenes Belo, a hero of the nation’s independence movement, over allegations that he had raped and abused teenage boys decades ago in East Timor.

Michelle Mulvihill, a former nun and adviser to the Australian Catholic Church, has long accused Catholic organizations of using the Pacific Islands as a “dumping ground” for abusive priests.

“We’re moving pedophiles and pederasts into the poorest countries in the world,” Ms. Mulvihill said after being told of The Times’s findings. The church “used them to discard those people who they didn’t want to confront.”

Vermont’s Roman Catholic Diocese faces another wave of lawsuits for past abuse

Vermont’s Roman Catholic Diocese, having spent more than $30 million to settle some 40 priest misconduct lawsuits dating as far back as 1950, faces another wave of court cases alleging more past child sexual abuse.

The state’s largest religious denomination is the subject of at least 16 more civil actions, records show.

The first case was expected to be heard this week in Chittenden County Superior Court. It involved the state’s most problematic priest, the since-defrocked former Rev. Edward Paquette, who has sparked more than three dozen civil actions based on his tenure in Burlington, Montpelier and Rutland from 1972 to 1978.

Speaking for the plaintiff, attorney Celeste Laramie simply noted that while she has heard church leaders express regret for the misconduct, “at the same time, the diocese continues to try to avoid liability and protect its assets from survivors of priest abuse,” she said. “When will the diocese practice what it preaches?”

Vermont Catholics first learned of the decades-long sex abuse scandal in 2002, when the state’s attorney general’s office reviewed allegations against 10 then-practicing and 30 past priests. The office didn’t charge anyone because the claims found credible were too old to prosecute under criminal statutes of limitations.

Accusers, however, were free to file civil lawsuits. The diocese spent at least $2 million to end nine of the first cases before reaching a $20 million settlement to cap almost 30 more in 2010 and, three years later, another $6.75 million to resolve what was thought to be a final 12 cases in 2013.

To pay for past civil actions, the diocese sold its historic 32-acre Burlington headquarters overlooking Lake Champlain for $10 million in 2010 and 26-acre Camp Holy Cross in Colchester for $4 million in 2012.

To protect the rest of their properties, church leaders placed each of their local parishes into separate trusts in 2006 so that the estimated $500 million in collective assets could only be tapped for “pious, charitable or educational purposes” and not jury verdicts, according to the “deed into trust” documents.

The latest lawsuits come as the diocese has seen its numbers decline from some 150,000 members, 130 parishes and nearly 200 fellow priests when new Vermont Catholic Bishop John McDermott was ordained as a priest in 1989 to nearly one-third fewer members, half as many parishes and only 36 active priests today, its website reports.

Also, why was the hospital locked down, he was not in a position to shoot anyone else?
