The state can prosecute even when a defendant refuses to do so. It's obviously much easier for the state to prosecute if the alleged victim cooperates, and a person who does not cooperate cannot reasonably expect a preferred outcome. Obviously, I don't think that this advances the cause of justice..but it's not my call to make.
