Supreme Court To Take Up Right to Carry Firearm Outside Home

RE: Supreme Court To Take Up Right to Carry Firearm Outside Home
The default position of gun laws should be " your a possible risk " and then everything should be done to lessen that possible risk. We do this all the time.

Of course. But I don't see any other way to improve the situation of the wrong people having guns. I think having more thorough background checks might help sort out some people who shouldn't have a firearm. Based on the hypothetical above, you would be more likely to be a better candidate for gun ownership than I would.

Just so I can better understand where you're coming from, could you outline the hoops law-abiders have to jump through to purchase a handgun where you live?

No rush. I fully expect 37 to solve all gun-related issues any minute now.  Smile

Anywhere in the us, at any time, the only hoop anyone has to jump through is the hoop of having a few bucks on hand.  Law abiding fetishists have flooded the market and screamed bloody murder at any attempt to fix what they've very demonstrably fucked up. We'll have the same problem with rifles on a similar turnaround - and the really fun part is...we don't currently have a problem with rifles. Trace data displacement lags behind consumer trends.

This is what the us not having a rifle problem looks like.......

What you'll find is the hoops are expensive too.

......

Here in Michigan the process varies. If you are buying a HANDGUN - you will need either a "Permit to Purchase" - or a Concealed Carry Permit. The Permit to Purchase requires the buyer to go to their local law enforcement -- after you figure out which - city, township, or county is applicable. You show up in person, usually stand in line - then get the application which you fill out and turn in. The law enforcement agency runs an initial background - and if favorable - issues the permit which is good for 15 days.

Then you go to the FFL licensed gun dealer - and fill out a form 4473 - A Firearm Transaction Record. This takes several minutes for a first timer - but after you have done a few - you can go through it in two minutes. But remember - 1 gun - or 101 guns --- you are going to fill one out EACH time you buy a gun. (all guns - not just handguns)

The dealer then calls in the NICS check. If it is favorable - you just bought a gun. If it bounces - you have to wait till either it clears - or three days -- or - in very rare cases (way less than 1 percent) it is denied. (People who are not allowed to own guns generally know this - and don't bother with this route.)

So -- Big deal you say???

Who's put out by this???

ALL OF US.

Why?? Because - Last year there were 40 MILLION NICS check performed. Each one takes a government employee a minute or so to process. Care to figure out how many man-hours that is?

So we wasted all those man hours - on a local level, and federal - policing the people who need it the least -- the law abiding citizen - who jumps through the hoops.

This is analogous to doing a total engine, transmission and trans-axle overhaul on a new car that needs washing. It's a horrendous waste of money that could be better spent policing those that actually need it -- the criminals, mental cases and other assorted morons that use firearms criminally.

Tell me you think this is money well spent.

I need a laugh.

Or..... you just ask your buddy if anyone wants to sell a gun. The people who get checks are fences making, in effect, a straw purchase.

Criminals and mental cases can't pass the checks, and yet they're still well armed. It's not exactly a mystery how they get those pistols.

Nope, it's money well spent. OB simply doesn't like that the law applies to everyone, not just people he thinks it should apply to. It's just childish whining really.

Even a total ban, in the us, will have a grandfathering provision. They always do. It's not something that would ever effect him or anyone else alive who he thinks should™ have guns.

Do you ever listen to youself?

You really do come off as a half baked idiot.

A grandfather clause?

How the fuck is THAT going to work?

So all of a sudden I will have to produce paperwork from 40 years ago - proving when I bought a gun?

Ever hear of ex post facto law?

You want to pass laws that require record kreping that not even the government has.....

Does the stupid hurt?

It will work the same way that it always works. Grandfathering, is when some new law only applies to future sales. You already have whatever cannon you're worried about - federal agents won't be coming through your door to get it.

You never seem to get tired of being hilariously wrong - but you probably should know more about guns and gun law, as a responsible gun owner no one has to worry about. Let wonder lead you to knowledge.

Quote:The Act included a number of exemptions and exclusions from its prohibitions:

The Act included a "grandfather clause" to allow for possession and transfer of weapons and ammunition that "were otherwise lawfully possessed on the date of enactment."[12]
The Act exempted some 650 firearm types or models (including their copies and duplicates) which would be considered manufactured in October 1993. The list included the Ruger Mini-14 Auto Loading Rifle without side folding stock, Ruger Mini Thirty Rifle, Iver Johnson M-1 Carbine, Marlin Model 9 Camp Carbine, Marlin Model 45 Carbine, and others. The complete list is in section 110106, Appendix A to section 922 of Title 18. This list was non-exhaustive.[12]
The Act "also exempted any firearm that (1) is manually operated by bolt, pump, lever, or slide action; (2) has been rendered permanently inoperable; or (3) is an antique firearm."[12]
The Act "also did not apply to any semiautomatic rifle that cannot accept a detachable magazine that holds more than ten rounds of ammunition or semiautomatic shotguns that cannot hold more than five rounds of ammunition in a fixed or detachable magazine."[12] Tubular magazine fed rimfire guns were exempted regardless of tubular magazine capacity.
The Act provided an exemption for the use of "semiautomatic assault weapons and LCAFDs to be manufactured for, transferred to, and possessed by law enforcement and for authorized testing or experimentation purposes" as well as transfers for federal-security purposes under the Atomic Energy Act and "possession by retired law enforcement officers who are not otherwise a prohibited possessor under law."[12]
In 1989, the George H. W. Bush administration had banned the importation of foreign-made, semiautomatic rifles deemed not to have "a legitimate sporting use." It did not affect similar but domestically-manufactured rifles.[13] (The Gun Control Act of 1968 gives discretion to the Attorney General of the United States to choose whether to "authorize a firearm or ammunition to be imported or brought into the United States," under what is known as "the sporting purposes test."[12]) Following the enactment of the Federal Assault Weapons Ban, the ATF determined that "certain semiautomatic assault rifles could no longer be imported even though they were permitted to be imported under the 1989 'sporting purposes test' because they had been modified to remove all of their military features other than the ability to accept a detachable magazine" and so in April 1998, it "prohibited the importation of 56 such rifles, determining that they did not meet the 'sporting purposes test.'"[12]
