The odds are pretty slim of the DA going ahead to trial for murder - as any decent defense lawyer could beat even murder 2.

I'll bet the DA doesn't want to try this case at all - because it's a dead fish of a case. Win and you piss off the cops - who you have to work with every day -- lose and you piss off the public and riots ensue - and you are the dumb fuck who botched the case....

Lean on the defendant with murder - and 25 years time - let them plead out to man 1 -and 10 years - and you get out of it without looking like a schlub.....

Possibly. Worth noting that the other cop involved is the state's witness.

At least til he gets on the stand....

Were I the DA I wouldn't stake my rep on it...

Why? Do you expect the jury to be unmoved by the officers description of a callous murder, or do you expect him to lie and blow the case?
I am the Infantry. I am my country’s strength in war, her deterrent in peace. I am the heart of the fight… wherever, whenever. I carry America’s faith and honor against her enemies. I am the Queen of Battle. I am what my country expects me to be, the best trained Soldier in the world. In the race for victory, I am swift, determined, and courageous, armed with a fierce will to win. Never will I fail my country’s trust. Always I fight on…through the foe, to the objective, to triumph overall. If necessary, I will fight to my death. By my steadfast courage, I have won more than 200 years of freedom. I yield not to weakness, to hunger, to cowardice, to fatigue, to superior odds, For I am mentally tough, physically strong, and morally straight. I forsake not, my country, my mission, my comrades, my sacred duty. I am relentless. I am always there, now and forever. I AM THE INFANTRY! FOLLOW ME!

This whole incident can be boiled down to a police officer’s hurt ego after letting a suspect get away with his weapon. Misdirected anger, plain and simple.

^^^^^^^^^ BINGO!

Far too much of police training nationwide is to assume the worst and dominate first.

I will tell you though, any good defense lawyer will try to argue, "If he was willing to grab at my weapon, and assault me, who is to say if he got away he wouldn't take someone hostage or harm someone else?"

Doesn't wash with me regardless, but that is what his lawyer might argue. If I were a prosecutor I'd point out the 47 minutes where they were getting along before the attempted arrest. I'd also point out other cases where people resisted and still made it to jail.

And the rebuttal to that defense would be that the officers were the ones who reached for the taser first, and maybe Brooks simply didn’t want to be tased. I see no reason or evidence to think that he wanted to do malicious harm to anyone.

I agree with you. But the taser was pulled out after started  to resist.  Resisting isn't always charged as a felony, but he did jerk away when the officer attempted to put the cuffs on him.The taser was pulled out after he tried to pull away from being handcuffed.  But not even that was worth a death sentence.

I think maybe Brown was disappointed that after 47 minutes of being polite to them, they still tried to arrest him. Believe me I am in no way siding with the cops. Seen far too many news clips over the years of blacks not resisting and still ending up dead. Shit, Floyd was handcuffed with 4 guys on his back and one with a knee on his neck. I feel for Brown. Blacks are unfortunately in a position with law that they are damned if they do, and damned if they dont.

A good defense lawyer would never, EVER argue that, especially in this case, because;

1. You can’t possibly defend killing someone for some act that a person might commit at some future point, and

2. Unless his partner did a runner and went for a doughnut, the likelihood of Brooks tasering cop, then walking up to take his weapon approaches nil.

I've never been tased but been shocked enough to know it rattles you soundly.  They need to rethink the taser's effectiveness in subduing an aggressor vs. the damage done and the panic it creates.  Cops are acting like Aunt Lydia with her cattle prod.  It's not their job to punish.
