Trump's Muslim immigration ban includes green card holders

For those who don't know the past six Presidents have used EOs to bar certain classes of immigrants from the US.  The Repubs used to love to whine when Obama did it and now the Dems are whining because Trump has done it.   It's a constant stream of whining that does seem to be going away anytime soon.

Presidents Obama, Bush 43, and Clinton did it 6 times each.  Reagan did it 5 times.  George H.W. Bush & Carter did it once each.  Carter barred all Iranians.  

Schumer's judge is going to get slapped upside her dummy head by the SCOTUS.  It's going to be fun to watch.

AFAIK none of those actions blocked people who had previously been approved for residency, or were already residing in the US. The reason people are complaining is because people who are lawfully allowed to be in the USA were being detained and prevented from entering the country. These people were already vetted, they have their visas, they have permanent residency, most of them don't have another place to go.

OK, after some in-depth research I think I've found the answer.

The news accounts are 99% BS and fake news intended to create mass hysteria.  

Trump did sign the EO, "Protecting the Nation from Foreign Terrorist Entry into the United States" on January 27, 2017.  

Obama and Congress had previously identified the seven countries of concern on December 18, 2015, when he signed into law the Consolidated Appropriations Act 2016, which included the Visa Waiver Program (VWP) Improvement and Terrorist Travel Prevention Act of 2015.  Those seven countries are Iraq, Syria, Iran, Sudan, Libya, Somalia, and Yemen.  That's why none of the countries Trump did business in is on the list.  Obama didn't regard them as a concern.

Now in Trump's EO the only country mentioned by name is Syria.  He referred to the list that Obama had previously identified.  

Under the Act if a citizen from a VWP program country, say England or South Korea, had been in one of those countries on concern that person had to get a visa before visiting the US.  The people in the countries of concern always had to have a visa.  

Trump's EO now bars those people from the seven countries that Obama had identified until they are more thoroughly "vetted".  When they are they might get a visa.  However, if it's determined that they have bad behavior (such as doing a honor killing or car bombing) they won't get a visa.  

Trump's EO also suspends the plan to import 50,000 Syrian refugees at this time because it's not in our national interest.

So, if anyone is open-minded about the issue he/she should read the EO and this link from Homeland Security that has FAQs about the Visa Waiver Program Improvement and Terrorist Travel Prevention Act.

Pretty sure the fact that otherwise legal residents of the USA were getting detained at airports and denied entry was the reason that there was any kind of hysteria.

To continue with the legal lesson you may want to bone up on 8 US Code Section 1182 - Inadmissible aliens.  It's a long read but it says that whenever the President finds that the entry of any aliens or of any class of aliens into the US would be detrimental to the interests of the US, he may issue an EO for as long as he likes to suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions that he may deem appropriate.

That's my summary since I can't get the Draft function to work.

Now pay attention.  You will notice that the President has that exclusive power.  He doesn't have to kiss the Congress Critters' behinds to do it.  And guess what?  Judges can't stop him from doing it.  So if he had wanted to he could have barred those people from entry and deported them on the next flight.  

The Judge should be disbarred for her criminal behavior.  

Trump is in charge and he can kick ass and take names if he wants to.  Of course Congress can impeach him but all hell would break loose if they did.

1) Judges can indeed stop him from doing it, legally. He may still do it in defiance of a court order; but then that would rather underline his criminality to obviously. And Congress can repeal that law.

2) Since he cannot demonstrate that all the people in the barred populations fall into the criteria laid out by that law, you'd best get ready for the expenditure of tax funds fighting entirely avoidable lawsuits as people whose rights have been violated seek redress.

Clearly, the violation of rights doesn't bother you. Hope you enjoy when it's your ass getting the Kafka Treatment®.

Uh, the E.O. has barred non-aliens too. What do you call green card holders and dual citizens? Naturalized citizens. That's why I started the whole thread. People who have already been vetted, who have careers, homes, families, lives. They are not aliens. But ignoring that, what you are talking about was written into law in the 1950s. But in 1965 Congress restricted this power (8 US Code Section 1152 - Numerical limitations on individual foreign states), stating " no person shall receive any preference or priority or be discriminated against in the issuance of an immigrant visa because of the person’s race, sex, nationality, place of birth, or place of residence."

Aegon: to be fair I believe green card holders are still "aliens". I'm a green card holder and my "alien registration number" is on my green card.

The issue is that green card holders should have been exempted from the order, because for the most part we are treated like US Citizens when it comes to rights.

True, but May is not the whole parliament. Just part of the party that made us more dependent on the US at the exact time when we should be separating ourselves from them.
