I'm not certain that equity of law provides for equity of outcome, which I believe is the goal. He should be held personally responsible for his actions, as we're not to the point where everyone is ok persecuting intent. Unless he went gogling, ways to incite hatred in America it'd be very hard to prove his intent. I believe the majority of default intents are still usually money and power.
