Any found within our borders, as per the constitution of the united states of america, as well as a mountain of trial law reasserting and reestablishing that fact every time we intentionally breach it for political convenience. Our borders extend to 12 miles out from the shoreline.
I was in the Coast Guard during the 1980's rush of Cubans fleeing Cuba. The USCG operated ( and Justice Dept upheld) the " wet foot/ dry foot" order.
If they made it to shore - we allowed them to stay. If they didn' t they got sent back....
Who can come and stay has NEVER been simple and the criteria constantly changes....
