He doesn't have to be "convicted" of any crime to be banned from the presidency. The amendment says nothing about conviction. If he gave aid and comfort to those planning an insurrection, he can't seek the presidency. It's a matter the SCOTUS will deal with, next year, before the election.

Sure, he need not be convicted, but you, me, and Mother Theresa know he will sue on the basis of "no conviction" ... to be argued eventually to a SCOTUS with three of his own nominees sitting in judgement (along with Alito and Thomas). As a result, I think his disbarment from office will require a conviction on one of the three named charges.
