I really agree with this line of thinking. The problem with hypothetical scenarios that ask "All other things being equal would you or would you not do X?l" is that all other things are never equal.

If I was about to kill the guy who was about to kill another guy, and someone saw me, by the same logic they'd kill me for being the guy who's about to kill another guy.

Sounds too complicated.

If someone was about to kill my wife or something, then my ability to kill would be firmly brought into question. I'd do anything I could to stop them, but the situation would have to be pretty specific for me to have no possible way except an outright instant kill.

 Nope. You've already made the choice to kill. They get to make an independent choice. 
However, one look at your mug and they'd never be able to do it.
