A California Republican claims Democratic-backed legislation aimed at protecting underage sex trafficking victims actually pushes minors into prostitution. "Beginning on Jan. 1, prostitution by minors will be legal in California. Yes, you read that right," Assemblyman Travis Allen, whose district covers parts of Orange County, wrote Thursday in the conservative D.C. publication the Washington Examiner. Allen's attack on the "terribly destructive legislation" has lit up social media — but the intention of the law is not as alarming as he suggests, its supporters say. Senate Bill 1322, which was signed into law by Democratic Gov. Jerry Brown in September, goes into effect on Sunday. "So teenage girls (and boys) in California will soon be free to have sex in exchange for money without fear of arrest or prosecution," Allen wrote. SB 1322, he added, "bars law enforcement from arresting sex workers who are under the age of 18 for soliciting or engaging in prostitution, or loitering with the intent to do so." My take, the unintended side effects of this are unknowable to a large extent. DAs around the state seem to think it takes a big arrow out of their quiver in eliminating a means of encouraging cooperation of the minors in testifying against their pimps and traffickers. Additionally, we have legislators quite removed from 'life on the streets' thinking they know better than everyone else. And the visuals of this are horrendous, as I think significant numbers of pedos are going to take note. And teens needing $$$$ to acquire the latest can't do with out fads. The unintended consequence of the DAs loosing a 'stick' to prod reluctant witnesses to testify against the pimps is worrisome, and that could very well translate into more trafficking. And having this start in Cali (instead of anywhere else) is concerning, 'good ideas' can turn up anywhere, having this one gestate in California could be foreshadowing something bad.
I don't have any stats on how many minors arrested under the old laws were adjudicated as adults, but I'd think the number would be small. I'm at a loss what's wrong with not charging minors. Is there something I didn't get?
In the view of some, it is a big step towards doing even less for underage prostitutes. If they aren't put in the system somehow, no services will be provided.
Again, I don't think very many are adjudicated as adults and put in adult prisons, but with out much impetus to charge them at all then they don't go in the juvenile system and at least have a chance at some form of rehab/counseling/education. Also, without the threat of prosecution as an adult, how many are still going to testify against their pimps ? Granted the current system stinks, but no system at all is not an improvement. We might as well just have cops pass out referrals to the nearest rectories. An improvement in the current system would be something along the lines of spending more money on services for teens and (IMO) keeping some incentive in the process for the teens to sincerely avail themselves of those increased services. Unfortunately California is still (IMO) teetering on bankruptcy, and in the Trump era, there will be no federal bailout lest 49 other states go belly up too, so California isn't going to do anything more that adds to their deficit problem. So they pass some touchy feely window dressing that not only doesn't cost anything, it actually saves money over what is now being done as fewer kids will feel any pressure to show up for counseling and programs, and the state isn't going to be putting the kids pimps in prison anymore either, and that is going to save some big bucks. I have noted twice now the threat of adjudicating teen prostitutes as adults is the 'stick' to encourage sincere and active participation in counseling and education programs with the goal of them no longer being teen prostitutes.
