I didn't render the judgement. It is....again...the opinion of a trump appointee and federalist society member, that this was...at the very least, a 5th amendment issue. If it isn't liberal on account of the positions of the person who rendered it, on what account is it liberal?
As another poster mentioned, including "under law" doesn't help, the executive -is- the law. They have to abide by their constitutional limitations.

Even assuming the worst, and accepting the doctored infowars video that the administration tried to fob off...they still have a binding duty to the 5th amendment.

Liberal is not just a political party.
And this doesn't seem to be a matter of law. If so, then what law are you referring to?

I'm not sure what I can add that hasn't already been said...and I still don't know in what sense this decision is taken to be liberal.

It's liberal in that it is a very generous or broad interpretation that leads away from the literal text and intent of the authors. It seems to be taken out of context from the original.

Does it though? The amendment states that "no person shall ... be deprived of life, liberty, or property, without due process of law". To me that implies that it requires due process of law to deprive a person of life, liberty, or property, not that the amendment only applies to matters of law.
In this case, there was no due process of law in order to revoke Acosta's press pass. This is what the judge ultimately ruled, that because the Trump administration couldn't give a sufficient reason for revoking the press pass, it was unconstitutional. The judge didn't rule that the Trump administration can't revoke press passes, only that they can't revoke them for no reason

A dryer reading of the amendment is difficult to conceive of, and is exactly what one would expect from a federalist society member. : shrugs :
