Tax the churches,  They are businesses regardless of their claims otherwise.

Not really the point.  The argument isn't about whether churches should be taxed (and I agree that they should) but whether not paying tax limits their access to the justice system.

Not to whether they should have access to the courts, even if it would be a bad idea to use it, no.  What is, is whether or not a sectarian dispute over property can be resolved in favor of the splinter group, which is clearly what the seperatists in question hope for.

I understand now.  Rather than the dispute resolved in a manner than might not please the larger denomination, they should simply fight for it.  Got it.

Precisely.  Which is why the courts SHOULD be involved.  If it determined that the splitters have a right to stay put, fine.  It a court determines they should get out, also fine.

But the notion that religious groups can't avail themselves of law courts solely because they're religious groups (which is what was intimated) is simply nutty.

In a sense, by not paying taxes, churches are indeed paying their 'fair share' - they are paying what the law requires.  Atheists may not like it (I certainly don't), but they aren't doing anything illegal or unfair: they are paying what the law requires.  That it happens to be nothing (in most cases) doesn't make it unfair.

Would you extend that restriction to people who don't make enough money to pay taxes in the first place?  If you get a tax refund, should that curtail your legal rights?

Yeah I understand the legal concept.  I just think they should be paying for the things we all have to help pay for.  And if they want government to stay away from their religion (unless it's endorsing it) then they should look for assistance elsewhere when two sects get into a pissing contest.  They either want government intervention or they don't.

And, no, we don't get a tax refund.  The government uses our money tax free through the course of the year and then wants more.  Luckily this year the amount of 'more' wasn't painful.
