You're right, he could have been transported there, in his vehicle, occupying the drivers seat, into the middle of a drivethrough queue, by Mr Scotty (Star Trek), in the recent past, when he was much more sober. That'd stand up in court, sure.

Parked, asleep, in a drive thru, yes. That's the story. Amusingly enough, there's a ton of shit that cops aren't actually empowered to do in a private parking lot.
Had they found him driving in it, maybe..but that's not what they said they found.....
The point of calling him a drunk driver is to maintain that he was a danger to others. In this thread or on that street. Because then, shooting him in the back might not be quite as bad.

I am not looking for an argument. Just asking a question to make sure I have the facts right on that.
Yup. But it’s unusual for cops to make an arrest in those circumstances. Not unheard of, but not terribly common.
Even the laws against public drunkenness are rarely enforced unless the individual is incapacitated or being a bunghole.

He wasn't "parked" - he was in an active drivethrough lane! And he also did not claim to have "pulled over" due to being intoxicated, when questioned by the officers! You'll just say anything won't you!

Take it up with the cops. I won't say anything, but the cops and murder apologists will, especially when they shoot someone.
Maybe they shot him for some crime he committed before they got there, or maybe they shot him for some crime he might commit in future. Point is, he's a criminal, so who fucking cares. It works.

Of course I’m not. How did you get that from what I’ve said? What I’m saying is that a drunk was found passed out in a parked car, and now he’s dead. There was a better way to handle that.

-as an example of cops saying any old thing... Breonna's law will make no knocks a no-go in ky, among other things.
The officers who murdered a woman in her bed, however, on their report, list her as a victim, but her injuries as "none", and have checked the "no" box in the "forced entry" line.
These officers definitely didn't force their way into her home and murder her in her sleep, she was just injured, in no way. That's probably why there hasn't been any action taken against them as of yet.
Remember, same guys were going to hang her boyfriend up for attempted murder on a cop...and about that warrant, that said they had credible evidence of drug dealing on the premises...
In any case, when cops say one crazy thing, and the defendant says some other crazy thing..there's supposed to be some sort of process to determine which of the two crazy things is the truth. Fuck, whadda they call that again? Oh yeah, a trial.

Some Googling around looks like if you are behind the wheel and the keys are in the ignition and you obviously drove to where you fell asleep, you can in some jurisdictions be charged with DUI. If the car is running I would say it's pretty clear that you got the car there by driving it. There wasn't anyone else in the car.

Either way, he didn't deserve to be shot and killed.
