impeachment is not a judicial proceedure but a legislative process in the form of judicial proceeding.   the judicial proceedure’s credibility comes from it being supposedly less political and more capable of giving well connected criminal political hacks their due.   it supposedly back stop the system against political criminality.   in addition the hack who seeks private gain by rallying the shameless can’t be daunted by the disgrace of impeachment.    but he will be daunted by the prospect of taking all the rest of his showers in jail.

if the federal government can’t put him there, then those who seek to leverage such hacks could even more easily make it safe for him in states because they can more easily subvert the entire judicial system of a state than the judicial system of the country.

if trump is not jailed for federal offense but merely state offenses, then the United states would be like a ship that, instead of sinking after being fatally holed by an iceberg, somehow got hung up on the iceberg and thus avoided sinking. it would merely perpetuate the myth of its unsinkability while obscuring the lethal nature of the damage it could sustain and the need for fundamental structural improvement to improve its survivability.

I’m not convinced that it’s any easier to subvert a state judiciary than a federal one. It would certainly be cheaper, though.
