"We the militia" or "We the people"? The right is ours, and -a- justification given was a well-regulated militia. I'm sure that many of the people involved could have given more elaborate arguments. They did not. I doubt that any of them could have foreseen our professional army (making a "militia" obsolete) - or that if they did, they gave it much concern at the time. Of course, this is not actually a document "granting us rights" - we have them..they're all ours (don't forget about 10). It's a document that limits government power with respect to -some- rights. But suppose that this -was- all that it were limited to (that either the founders would have or we have since decided to take that approach). Are you okay with militias cropping up to take advantage of that?

In 1789 the militia referred to organized companies, equipped with muskets and bayonets, with junior officers generally elected by the troops under commanders appointed by the governor. There were state by state variations in all this which generally led to the utter failure of the militia system during the Spanish-American War and its replacement by the National Guard in 1903.

The additional spotting distance from the horizon doesn't apply... if a cruise missile is coming: we should know that by the time it gets within 500 miles of us (if not well before that). It doesn't even apply to subs from well within that range: we have sensors in the water like crazy... and a blimp high in the sky isn't going to do shit about it.

Since 'militia' was the people, yes it did. And the Supreme Court says so.

Everywhere in the Constitution where it says "the people" it means that; the Second Amendment is not an exception.

Yeah...a 5-4 vote with the corporate nazis all on the side of the death merchants. They overturned a more logical decision which had stood since 1939. How many will die because of their lack of ethics.

You talking about Miller? I wouldn't hold that up as a shining example of jurisprudence, personally. By the time the case went before SCOTUS, Miller was missing or dead, and only the government's side was presented.

Non-adversarial jurisprudence is hardly good jurisprudence, whatever one may think of the outcome.
