1. The judicial system is fallible, executions are irreversible.
2. Justice should not mean society taking revenge. The death penalty is always cruel and unusual, death row is torture.

This is the face of Kwame Ajamu (previously Ronnie Bridgeman) moments after he was exonerated of murder. He spent 27 years in prison for a crime he didn't commit and very nearly faced the death penalty.
The death penalty is abhorrent, and not just for the obvious reasons of permanent injustice or moral considerations. As an atheist I'm not sure what happens after death. If I were to venture a guess though I'd say absolutely nothing, and that sounds like the easy way out to me where there should be hard consequences.

Good thing he got out. I'm reminded of a gentleman from Texas who didn't. Convicted based on "evidence" that amounted to witchcraft and thoroughly exonerated by a more critical examination of that evidence - in a trial with misconduct so egregious the prosecutor himself was implicated, his appeal for a stay was denied and he was put to death.
The state was concerned, for it's part, that granting him a stay would call into question the -other- 30 years worth of cases said investigators had been using witchcraft to "solve"...and for the governer's part, good ole Slick Rick, the response was, essentially "well, he was a scumbag". He may have been a scumbag, scumbag, but if being a scumbag was a capital offense your head would've been on the block long ago.
See, we even execute em when we know they're innocent......so....this certainty of guilt business is just, well, superfluous..lol.

There are some crimes that are so bad that we cannot and should not allow them to happen again.
Man is not perfect. Mistakes are made. To think that someone has been executed for a crime that they did not commit is just horrific. However, mistakes cut both ways.
There have been cases, not many, admittedly, where people have murdered, escaped and murdered again. How do you explain that to their loved ones?
Society has a right to be protected and an obligation to protect.

Talk is cheap.
It's one thing to fantasize about violent deaths of people you hate (although that's probably not healthy either, come to think of it) - it's another to personally put to death a defenseless human being - however guilty they may be. Very few people can do the latter without serious psychological repercussions. Those that can are mostly psychopaths and they get off on it.
I'm against death penalty on principle. Institutionalized murder is something, I believe, civilized societies can do without.

No and no.
If society, as a whole, believes in capital punishment, then society has to accept the guilt that goes with getting it wrong. Society may or may not care. I do.
On the other hand, if society, as a whole, doesn't believe in capital punishment, then society likewise has to accept the guilt when it gets it wrong and a murderer escapes to kill again. Society may or may not care. I do.
In the society in which I live, there seems to be a bias. That bias results in the guilt felt by executing an innocent exceeding that felt in the case of a murderer escaping and repeating his crime. So be it. I accept the majority view. Personally, I feel the opposite.
