It’s the institution that enforces our immigration laws and carries out federal directives regarding the same.
One of the (many) problems with ice at present....is that it doesn’t actually matter what’s written in our laws. Like so much of our government, it’s been hallowed out by and for trump sycophants.

It is an relatively new law enforcement institution. It has not been around the entire history of our nation.
Nothing in the Constitution sets up any law organization for that matter. Our Constitution only gives power to congress to make laws, which is how our law institutions get created. "Homeland Security" is also a new institution.
Many of the institutions we have today, were not around at the founding of the country, but created over time. The CIA is another one that did not exist at the founding.
Our Air Force also did not exist at the founding for obvious reasons.
