Characterizing it as a "loophole" or as "facilitating illegal activity" is debatable. They act as an index to what's available on bittorrent, which is used for both legal and infringing content.
There are already technical ways to avoid the need for bittorrent trackers which are widely used. Going after TPB etc al makes headlines but is pretty much useless in stopping infringement.
