Judge rules accused priest Bialkowski can control widow's $2 million estate

An Erie County judge has ruled that a Catholic priest who has been accused of sexually abusing children can spend a dead parishioner's $2 million estate as he pleases, despite the objections of her relatives.

Erie County Surrogate's Court Judge Acea M. Mosey dismissed allegations by the widow's family that the Rev. David W. Bialkowski, former pastor of St. John Gualbert Catholic Church, "groomed" Ruth Peters to become the executor of her estate before her 2019 death.

The March 31 ruling clears the way for the suspended priest, who is on the diocese's list of priests with “substantiated allegations of abuse of a minor” and who is accused in two Child Victims Act lawsuits of sexual abuse, to inherit $125,000 directly, in addition to controlling the remainder of the $2 million estate.

He is one of two Buffalo priests who were accused of taking advantage of elderly female parishioners and inheriting large sums of money when they died.

In 2016, Rev. Joseph Klos inherited the lion’s share of an estate worth at least $467,000 from a widow he befriended while he was pastor of Sacred Heart of Jesus Parish in Lancaster. He also made $242,500 from the sale of a Florida condominium that was once owned by the widow. Relatives of that widow criticized Klos but did not challenge the will, which the Surrogate's Court ruled was valid.

Pope rules out sexual misconduct probe of Canadian cardinal

The Vatican has said it will not probe accusations of sexual misconduct against one of its top cardinals due to insufficient evidence.
Canadian Cardinal Marc Ouellet was named in a class-action lawsuit accusing 80 clergy members of sexual assault in his home province of Quebec.
A former diocesan intern alleged the Cardinal inappropriately touched her at public events between 2008 and 2010.
Cardinal Ouellet said he firmly denies the allegations.
The Cardinal is not facing criminal accusations and the allegations have not been tested in court.

In a statement released on Friday, Cardinal Ouellet called the allegations "defamatory", and said he intends to actively participate in a civil investigation "to ensure the truth is established and that my innocence is recognised".

The civil lawsuit represents more than 101 people in total who allege they were sexually assaulted by members of the clergy in Quebec.
The earliest of the claims date back to 1940. Some plaintiffs allege they were minors when the assaults took place.

Marsaxlokk parish priest ‘misappropriated’ tens of thousands on porn sites

Marsaxlokk parish priest Luke Seguna is believed to have spent nearly €150,000 of parishioners’ money on pornographic websites as he faces accusations of money laundering in court.

Sources close to the investigation told Times of Malta that Seguna was accused of misappropriating parishioners’ donations and used large volumes on the sites that provide live sex shows by performing artists against a fee.

It is understood that this went on for several years.

Seguna is believed to have told investigators he was struggling with a “sexual crisis” triggered by a major health problem at the time.

He was also charged with fraud, falsifying a public deed and using a falsified document. Seguna had hundreds of thousands of euros deposited in various bank accounts and a collection of five motorbikes and two cars, despite a relatively meagre income as a clergyman.

Clergy members, however, are exempt from that requirement "with regard to any confession made to the member of the clergy while functioning in the ministerial capacity of the member of the clergy and without the consent of the individual making the confession" if the person made the confession directly to the clergy member, and if the clergy member is "under canon law or church doctrine or practice, bound to maintain the confidentiality of that confession," according to state code.

Attorneys say diocese has been slow to disclose priest abuse files

Dozens of personnel files for clergy and others associated with the Roman Catholic Diocese of Albany as of midday on Friday had not been turned over to the attorneys for hundreds of victims who allege they were sexually abused as children.

Despite court orders instructing the diocese to turn over the materials, and public proclamations by Bishop Edward B. Scharfenberger and other officials that the diocese is being transparent, the attorneys said more than half of the treatment and personnel files for roughly 60 accuses priests had not been disclosed before a Friday court conference.

The pre-trial discovery process is supposed to unfold as a slow-moving mediation plan is being negotiated by the church and attorneys for more than 440 alleged victims of abuse who have filed lawsuits against the diocese — or individual priests, parishes and schools — under New York's Child Victims Act.

During the conference Friday before state Supreme Court Justice L. Michael Mackey, attorney Cynthia LaFave, who is part of a mediation liaison team for the plaintiffs, told the judge that it is critical for the attorneys to receive both the priests' personnel files as well as detailed information on the diocese's insurance policies and financial assets.

Three more women file sexual abuse claims against Quebec Catholic church

After Quebec Cardinal Marc Ouellet was accused by a woman of sexual assault in a class-action lawsuit introduced this week, more women have come forward with similar allegations against members of the province's Catholic Church.

"It exploded since yesterday," Kirouack said about the introduction in Superior Court of two class-action lawsuits against members of the Catholic Church in Quebec, involving hundreds of alleged victims.

It was the media reports about the allegations against the cardinal, however, that led to numerous calls to Kirouack from women. She said the high-profile allegations by an adult woman broke the stereotype commonly associated with church abuse — that it involves young children, mostly boys.

In the first lawsuit, in which Ouellet is named, 101 alleged victims have accused about 88 priests or diocesan staff of sexual assault. Around 19 women are among the alleged victims, Wee said Wednesday in an interview.

Church Releases List Of Priests Accused Of Sexually Abusing Minors In Colombia

The Catholic Church in Colombia has released the names of 26 priests who were investigated for alleged sexual abuse of minors there, local media reported Saturday.

The Archidiocese of Medellin revealed the list of those accused between 1995 and 2019 in response to a court ruling in favor of Juan Pablo Barrientos, a journalist investigating an alleged network of pedophile clergy.

"Most of these priests ... were suspended for a little while, and went back to being priests again," said Barrientos, who has been investigating sexual assaults by priests for years, in a video released Saturday.

In a video posted on the Archdiocese's Twitter account, the religious figure accused Barrientos of "an aggressive smear campaign against the Church."

According to the journalist, the Church divulged the names "because the Constitutional Court has forced it to do so."

In 2019, Barrientos published the book "Let the children come to me," an investigation into pederasty and cover-up within the clergy in the South American country, where most people are Roman Catholic.

The Church tried to stop publication of the book with legal actions that failed.

Utah lawmaker wants church leaders to pass a background check before working with children

A Utah lawmaker wants government-mandated background checks for church leaders and volunteers who work with young people — an effort, he said, that could prevent predators from grooming children for sexual abuse.

Sen. Keith Grover, R-Provo, doesn’t seem confident that his proposed legislation will become law, but he said in an interview last week that he hopes it will start an important conversation about sexual abuse and how to protect children.

He spent his career as an educator and now works as a real estate agent, and he has been required to pass background checks for both professions.

Why, he asks, don’t clergy face the same requirement? Or the church volunteers who take young people on camping trips, play night games with them or offer them support?

Priests transferred by German diocese continued to abuse

TRIER, Germany — The Diocese of Trier transferred alleged or convicted perpetrators of abuse to new locations in and outside the diocese, where they reoffended against young people and children, said an independent commission’s interim report on abuse in the diocese from 1946 to 2021.

The German Catholic news agency KNA said the report’s statistics showed 513 victims of abuse in the diocese’s area of responsibility “could be identified by name or anonymously” for the period from 1946 to 2021.

“In a large number of cases at least … no measures were taken on the part of the diocese to protect potential victims from sexual abuse,” the commission said.

The report listed 195 people as accused or convicted perpetrators of sexual abuse. The commission said the numbers were likely to increase as it delved deeper into the files.

KNA said the independent commission was launched in June 2021.

Bishop Bernhard Stein, who headed the diocese from 1967 until his retirement in 1980 is accused of having known about the sexual abuse of children by clerics and of having shielded the perpetrators.

The interim report also contains two serious historical cases that the commission said documented the “practice of diocesan administrations dealing with cases of sexual abuse internally and concealing them from the public, even from the access of state law enforcement agencies.”

AT least 130 Jesuit priests have been accused of committing sexual abuse against children between 1927 and 2012 in Spain

The El Pais newspaper, as part of its ongoing probe into paedophilia within the Roman Catholic Church in Spain, reported there were at least 160 victims who suffered at the hands of the Jesuits.

The paper said that the Jesuit who faced the largest number of complaints was Barcelona-born priest Emilio Benedetti.

Benedetti worked in several Jesuit schools and died in 2019.

He’s accused of committing sexual abuse against at least 13 victims between 1969 and 1973 but no action was taken against him.

The Catholic Church in Spain as a whole has commissioned an internal probe run by a solicitor who said in July that he’d received news of ‘hundreds’ of previously unreported sex abuse cases.

Public funeral for former Archbishop of Milwaukee sparks controversy

Tuesday’s public funeral for former Milwaukee Archbishop Rembert Weakland sparked a lot of difficult emotions and conflicting points of view.

In his 25 years as archbishop from 1977 to 2002, Weakland admitted to covering up sexual abuse by priests and using $450,000 in church funds to silence a male lover, who later accused Weakland of date rape. Weakland maintained it was a consensual relationship.

“It’s an embodiment of how little has changed and a slap in the face to survivors,” said Chris O’Leary, who was abused by a priest when he was a child. “There’s too much passivity. There’s too much enabling.”

O’Leary found out there was going to be a public funeral for Weakland and drove from St. Louis to stand outside of the service with a sign that reads, “What About Survivors?”

“No one should be going to this funeral,” said Peter Isley, who was abused by a priest when he was a child, and now leads the survivor advocacy group, Nate’s Mission. “By going to the funeral, priests and bishops are showing the community, they’re above all of it."

Isley and other survivors tied up photos outside the cathedral of more than 75 abusive priests under Weakland’s tenure. They also displayed posters showing young clergy abuse survivors with the message, “stolen bodies.”

In a 2008 state court deposition, Weakland admitted to shredding copies of sex abuse documents, failing to notify authorities about allegations, and moving sexually abusive priests from parish to parish without warning about their histories.

Catholic Priest In Southern Maryland Charged With Indecent Exposure On Highway

Reverend Jaroslaw “Jerry” Gamrot, 58, who serves at Holy Face Catholic Church and Little Flower School in Great Mills, has been charged for an incident that reportedly happened in July on a highway.

Charging documents for the incident indicate that on July 25, Gamrot was traveling west on Route 70 in Frederick with no pants on and was allegedly masturbating.

A male victim claimed to police that he was exposed to him on a public road near the 56-mile-marker. The victim claimed to state police that he was targeted by Gamrot, as he continued to pull up next to his vehicle multiple times to expose himself.

This allegedly occurred three times.

However, on Gamrot’s final maneuver, the victim took a picture of the vehicle’s license plate and the inappropriate action taking place.

I once looked up to my uncle, the Jesuit priest and teacher – then I discovered the monstrous truth

My new acquaintance who, it turned out, had been a pupil during the 1960s at Wimbledon College, the Jesuit school in south-west London where my uncle had taught and where, I was told over the bar-room chatter, he had gained a reputation as a man with a predilection for young boys.

Uncle Peter – Father Peter Orr – was my father’s elder brother. Peter, whose visits to my childhood home near Dublin I loathed. Peter, a teacher and pedant: he once returned a letter I’d dutifully written to him from boarding school with my grammar and spelling mistakes circled in red ink. Eccentric Peter, who so embarrassed me as a teenager by recounting our family history to strangers on buses and in cafes. Peter, the serial paedophile, it turns out.

It was not until I was put in touch with the Jesuits’ safeguarding officer in the UK, Jo Norman, that I learned the full extent of my uncle’s depredations. Norman, who has since moved on from her role, told me the Jesuits had received numerous complaints “of a sexual nature” against my uncle, including some in schools. Most of these came from the UK and Ireland, and these are the only ones officially listed in the Jesuits’ records, though it seems there were others from farther afield.

What seems clear is that Peter Orr’s superiors had very little idea how to deal with him. Like other Catholic orders, the Jesuits preferred to handle such cases in-house, only rarely referring the matter up to Rome. A ploy common to many orders was to move the perpetrator quietly away from the scene of his misdeed in the hope he would not reoffend.

“Even today, priests are virtually untouchable as far as the law is concerned,” I’m told by Jon Bird of the National Association for People Abused in Childhood, a British organisation that supports recovery from childhood abuse. “The Jesuits and other orders should report offending priests but generally they don’t.”

De La Salle school sold to pay for abuse restitution and ageing brothers

De La Salle Brothers will sell their Malvern school, which has net assets of $27 million, to fund compensation claims from victims of historical sexual abuse and to financially support ageing brothers.

The buyer, Melbourne Archdiocese Catholic Schools, will take over the running of the college for more than 1000 boys in years 5 to 12.

Lawyers say they have more than 50 ongoing claims against the De La Salle Brothers nationally.

A sale price was not disclosed, but the school, one of four owned by the brothers, has more than $27 million in net assets, according to its financial accounts for the 2021 calendar year.

The Royal Commission into Institutional Responses to Child Sexual Abuse said Catholic Church data showed that 328 people made a claim of child sexual abuse to the De La Salle Brothers between 1980 and 2015. The brothers accounted for 7 per cent of all claims made to a Catholic Church authority.

Chaplain who sexually abused inmates gets 7 years in prison

Behind a closed chapel office door inside a federal women’s prison in California, a chaplain forced inmates seeking his spiritual guidance to have sex with him, exploiting their faith and their powerlessness behind bars for his own gratification, prosecutors said.

James Theodore Highhouse was sentenced Wednesday to seven years in prison — more than double the recommended punishment in federal sentencing guidelines. U.S. District Judge Haywood S. Gilliam Jr. said the guidelines, which call for a sentence of less than three years, “seriously underestimate the seriousness” of Highhouse’s conduct.

Highhouse, who was arrested in January and pleaded guilty in February, would tell women he abused at the Bay Area lockup, that everyone in the Bible had sex and that God wanted them to be together, prosecutors said.

An Army veteran, he pressured one inmate into intercourse on Veterans Day by telling her she needed to serve her country and on Thanksgiving by telling her she needed to show her gratitude for him, prosecutors said.

I’m an angry, disgusted Catholic these days. I’m stunned, horrified, furious, and grieved. The past decade has been brutal.

I admit I was ignorant for a long time. I know the Church is both “Spirit and mud,” as Deacon Keith Fournier explains it. But I did not know the mud was so deep, so toxic. I trusted that the men in priestly collars—and especially those in miters—were genuine in their faith, pure in their love for God, sincere in their desire to serve. I trusted that they were, indeed, shepherds. I never thought they could be wolves in disguise.

It sounds ridiculous now. If you want to chide me for being a colossal idiot, get in line behind me. But there you have it. I trusted. I believed the best.

No more. I am not that Catholic any longer. And I am glad. Though painful, I hope this shattering of ignorance and foolishness is also purifying, so there is nothing at all to cling to except Jesus.

Last week saw the death of Archbishop Rembert Weakland, a corrupt prelate who used his flock’s money to try and shush one of his homosexual lovers who’d accused him of assault. He also covered up for a monstrous priest who had abused deaf children.

He was immediately lauded for his many gifts by Fr. James Martin in this now-deleted Tweet

When Martin was justly skewered for heaping praise on an abusive prelate, we were treated to yet another manipulative, patronizing, spiritually abusive lecture about how Jesus ate with sinners and how we’re all in need of mercy. When that also backfired, Martin then apologized

And now, Robert McElroy, a bishop who protected a sexual-predator-Satanist-priest received his shiny red cap and changed his name to Cardinal. A man who saw fit to provide cover and safety for the literal devil is elevated to be a prince of the Church, joining the ranks of those who will elect the next pope.

There is no way Pope Francis does not know the details of his candidate for promotion. The pope is giving the faithful a cardinal who chose Satan over the body and soul of a young woman who was diabolically raped by a wicked priest, to say nothing of choosing the devil over Christ.

McElroy should be made to stand in St. Peter’s square, before a thousand microphones and cameras, and repeat the name Rachel Mastrogiacomo, over and over and over. He should be made to confess how he protected the satanic priest who ritually raped her during Holy Mass.

Bishops who protect predatory, satanic priests should be laicized and put in jail, not elevated to the rank of cardinal and celebrated. If the pope, or any other cleric, expects the faithful to believe that the days of tolerating sexual abuse by clergy are behind us, they truly do consider us to be the stupidest of sheep.

These guidelines were written by a Catholic for other Catholics so that they don't disrespect victims of clerical sexual abuse and harass them even more.

This fails to acknowledge the power differential that exists between a priest (often viewed as a representative of God) and a parishioner or other Catholic. When the victim expects that they can trust a person and that trust is broken, they do not always know what to do next.
