It all fails with enforcement. There are a ton of laws on the books for that shit. Letting that mom off the hook just tells everyone else that they can be lax. It didn't start with her screwing up. It's been going on for decades. Hell, I keep my stuff locked up even though the youngest son is almost 30 YO. I'm not worried about my family shooting each other, but about people other than them potentially stealing them. I have a 500 pound safe to hold them. It was a bitch for my other son and me to get into position in the house. There isn't a crack head that'll be able to move it, what with it being anchored to the floor, and the anchors only accessible when the door is open.

As far as " deterance to others" - do you really think most people would find jail more of a deterance than their child dying of a gunshot? Most mothers I know would willingly do jail time to prevent such a thing. Or, at least I would like to think they would.

That's the flip side of the coin, for sure. Then shouldn't the laws for leaving firearms accessible to kids be dropped if they're only going to be selectively enforced? That would remove the hypocrisy.

We don't.  If you really sit back and consider how many guns there are in the us, the thing that would strike you is how -low- our gun crime, injury, and death stats are compared to the number of guns per cap and the same anywhere else.  

When it happens, and it does happen, we just don't enforce our laws.  Whatever preventative benefit those laws have to coerce better behavior among law abiding people ( the overwhelming majority of gun owners), better than our already good behavior all things considered, just isn't going to work until we do.

I get it, don't get me wrong.  When a parent loses a kid we think "what could we do to them that's worse than that" - still.  I know, they're bawling, it's the worst thing that could ever happen to them..and it's going to be a bad look...it certainly wont help anyone running for office....but we have to charge them with the crime(s) they committed.

CAP laws aren't outdated, most of them are younger than the members of this board.

CAP laws aren't even remotely unconstitutional, they don't infringe in any way on any personal right, and states have the authority to write and enforce them.

You're right. After decades of dealing with gun nuts, mostly my relatives, I'm not inclined to be nice any more.

Yeah, when the parents are smart enough to teach their kids not to touch the guns. And in some fantasy land the kids will never ever mess with the guns that AREN'T SAFELY STORED EVEN THOUGH THERE ARE CHILDREN IN THE HOUSE WHO CAN ACCESS THEM.

That makes the gun owner lazy, not the law.  The law exists to penalize those lazy behaviors that lead to a child being in possession (and use) of an unsecured firearm.  

It' s hard to teach kids not to touch them.- but it obviously can be done. Every generation that came before the CAP laws since the invention of firearms survived - without having firearm death being a significant percentage of childhood death.

-and every generation that existed before the laws pertaining to a minor operating a vehicle also survived.

The laws in both cases are aimed at reducing the amount of people within that generation that don't, and to provide recourse for when the parents are too lazy to be entrusted with the care of a minor.
