Georgia is a CAP law state.

O.C.G.A. 16-11-101.1 (2010)
16-11-101.1. Furnishing pistol or revolver to person under the age of 18 years 


(a) For the purposes of this Code section, the term:

(1) "Minor" means any person under the age of 18 years.

(2) "Pistol or revolver" means a handgun as defined in subsection (a) of Code Section 16-11-125.1.

(b) It shall be unlawful for a person intentionally, knowingly, or recklessly to sell or furnish a pistol or revolver to a minor, except that it shall be lawful for a parent or legal guardian to permit possession of a pistol or revolver by a minor for the purposes specified in subsection © of Code Section 16-11-132 unless otherwise expressly limited by subsection © of this Code section.
©(1) It shall be unlawful for a parent or legal guardian to permit possession of a pistol or revolver by a minor if the parent or legal guardian knows of a minor's conduct which violates the provisions of Code Section 16-11-132 and fails to make reasonable efforts to prevent any such violation of Code Section 16-11-132.

(2) Notwithstanding any provisions of subsection © of Code Section 16-11-132 or any other law to the contrary, it shall be unlawful for any parent or legal guardian intentionally, knowingly, or recklessly to furnish to or permit a minor to possess a pistol or revolver if such parent or legal guardian is aware of a substantial risk that such minor will use a pistol or revolver to commit a felony offense or if such parent or legal guardian who is aware of such substantial risk fails to make reasonable efforts to prevent commission of the offense by the minor.

(3) In addition to any other act which violates this subsection, a parent or legal guardian shall be deemed to have violated this subsection if such parent or legal guardian furnishes to or permits possession of a pistol or revolver by any minor who has been convicted of a forcible felony or forcible misdemeanor, as defined in Code Section 16-1-3, or who has been adjudicated delinquent under the provisions of Article 1 of Chapter 11 of Title 15 for an offense which would constitute a forcible felony or forcible misdemeanor, as defined in Code Section 16-1-3, if such minor were an adult.

(d) Upon conviction of a violation of subsection (b) or © of this Code section, a person shall be guilty of a felony and punished by a fine not to exceed $5,000.00 or by imprisonment for not less than three nor more than five years, or both.

About as often as the vast majority of our guns laws.

So the barkers want to pass another law that makes it really, really illegal.

Oh well now, we can't let the state make this boy an orphan!

Now if the parent had marijuana on them, then we could send them to jail and put the kids (I say plural kids here, since if it were marijuana instead of a gun, the 6 year old girl would still be alive) in the foster system.

Or if the parent were black, and pulled over by the cops -- and then the cops shot the parent for reaching for their license because they 'feared for their life', thus making the children fatherless--that TOO would be okay.

But don't DARE make the children 'orphans' because their mom negligently led to the death of another human being. There's absolutely NOTHING that could be done to stop this. Which is why other countries have the EXACT same gun epidemic that we do. The US has an average of 42 gun deaths each day. Japan has 44 per day. Err year. Err 8 years. Close enough, right?
"Tradition" is just a word people use to make themselves feel better about being an asshole.

You think jail is worse than what she' s gonna have to live with,  every day for the rest of her life?

Or are you just looking for some good ol' biblical justice?

Ever know somebody who shot somebody as a toddler? I do. That kid' s gonna be a basket case already - without the trauma of getting stuck in the kid mill - aka foster care system.

Or - maybe we should just put the kid on death row. He shot somebody, right?

Fact is - it' s a fucked up deal all around - with no winning solution.

It all fails with enforcement. There are a ton of laws on the books for that shit. Letting that mom off the hook just tells everyone else that they can be lax. It didn't start with her screwing up. It's been going on for decades. Hell, I keep my stuff locked up even though the youngest son is almost 30 YO. I'm not worried about my family shooting each other, but about people other than them potentially stealing them. I have a 500 pound safe to hold them. It was a bitch for my other son and me to get into position in the house. There isn't a crack head that'll be able to move it, what with it being anchored to the floor, and the anchors only accessible when the door is open.

Mom isn' t getting " off the hook".

She' s got to live with that shit forever.

I suppose if she was a psychopath - then jail would be appropriate.

She should lose her guns - and the right to own them. 

As far as " deterance to others" - do you really think most people would find jail more of a deterance than their child dying of a gunshot? Most mothers I know would willingly do jail time to prevent such a thing. Or, at least I would like to think they would.

Am I wrong?

Those gun laws are barely enforced at all anyway, and yet the NRA fights ANY potential laws from passing tooth and nail, especially if they're likely to actually help solve crimes. See #4 for a good argument for exactly why the "Gun owner registry" the NRA is actually a damn good idea (Fun fact: it turns out that if a guy gets shot with, say, a Glock Model 17, in, say, Knoxville, and the Knoxville PD have the name of everyone in the area who owns a Glock Model 17, they can narrow down the suspects in that case considerably.
